VENTURES: Constitutes A Conflict Of Interest

TUESDAY-

The Building that Larry North worked in was Modern deco, much like the building in Philadelphia that Yvette and all of our friends worked in...

It had a stylish cafeteria just like the building in Philly, that served good food..So we were able to have breakfast and lunch and didn't have to cook at home as much..

It had a gym.....Which we all loved..

Larry's suite of The Innocence Project had a law library and a media room...and a staff of 25 attorneys,

10 para-legals and at least 4 office managers...

This case however was his baby and both Olivia and I suspected it was personal with him...

"Larry, you are doing good for yourself...I am impressed...Proud of you."said Olivia.

"I'm proud of you ,,, Got a Law firm up and running...Four Attorneys, An Investigator...I understand Beverly's mom is your office manager?" said Larry.

''And we allow other lawyers, all who live on our block to use our facilities, to work remotely, use our law library, our media room etc."said Olivia.

''Do you charge?" asked Larry.

''Nah, they're our friends and neighbors.. I acquired a Bus service.. A grateful client gave us two buses as payment...They transport us to and from bars and clubs, so we don't have to drive and risk DUI's." said Olivia.

"Go ahead girl, killin the game!"laughed Larry..

We all sat in his conference room

We were served Coffee

Larry entered the room..

''Well Guys, I'm glad you got to enjoy the Bay Area this weekend... but now it's time to get down to cases." he said.

"This is our client, Amin Jenkins.... He's been in San Quentin for two years, convicted of Rape and armed robbery of this woman.

Her name is Samantha Wright.

Our client was convicted of forcible rape , two counts ,forcible Oral copulation, two counts and one count of robbery... Sentenced to 10-15 years...

His Public Defender didn't even try to defend him...He talked him into taking a plea deal in lieu of a trial..he said he could have gotten 50 years.." said Larry.

"He didn't try to defend him? What kind of legal representation is that? Ouuuuu I hate lawyers like that." said Beverly.

"Probably Jaded, Juggling about 10 cases...This was just one to cross off the books.." said Nelson.

"This was somebody's life."said Olivia. "I was getting to that point..That's when I decided to leave the Public Defender's Office." said Olivia.

"I think we all did.. That's why I told you Bresha and you too Josie that you're both fortunate not to have to go through that meat grinder that Olivia, Beverly, Nelson and I did." said Larry.

"I've heard and I've seen." said Josie.

''We do a couple of cases a year Pro Bono and we usually do it for the Public Defender's Office." said Bresha.

''So does my firm."said Tony.

"Sooo they got smart over there , they started farming some of the work out huh?" said Larry North.

''New Leadership!" said Olivia.

"Hey How is my girl Jazzy doing?

Do you ever see her?" asked Larry North

''Every day.. she and her husband live a few doors down from us." said Beverly... She and my cousin Kayla, who lives across the street from us work at the same law firm..." said Beverly.

"She was doing the uh Assistant District Attorney thing for awhile."said Larry.

"She hasn't done that in years...She's been in the private sector for quite awhile now...She just worked a case with us, not too long ago."said Olivia.

"Glad to know all of our old friends are doing good.. When you see her tell her I said Hello." said Larry, then drawing us back to our case.

"But back to Mr. Amin Jenkins. He grew up in Oakland, California, and was the third of six children. He was raised by his mother, a homemaker, and his step-father, a highway patrolman. In 2019, when Mr. Jenkins was a young man who had recently graduated high school (the only one of his mother’s four sons to do so), his life took a horrific turn: he was wrongly charged, and later convicted, of robbery and rape.

On April 8, 2020, Here in San Francisco, a white female clerk, Samantha Wright was working at a shoe store when, sometime between 11:30 AM and 12:00 PM, she was raped and robbed at gunpoint. During the rape, the assailant ejaculated and wiped semen onto her sweater.

Following the rape, the victim was taken to the hospital where vaginal swabs were collected. Her clothing, including the sweater with the semen stains, was collected and marked for identification. She then went to the police station and was shown yearbooks from a nearby high school but was unable to find her assailant. In fact, she did not identify Amin Jenkins until she saw a wanted poster for him on unrelated charges, and was then shown a photo lineup where she identified Jenkins as her assailant. A witness who worked at the store next to where the rape occurred was shown the wanted poster with Jenkins picture and identified him as a man who had been in her store earlier that day. At trial, in addition to the eyewitness identifications, the prosecution proffered testimony from a criminalist with a state laboratory, who testified that the semen found on swabs was deposited by someone with blood type A and PGM 2+1+, which are consistent with Mr. Jenkins typing. Jenkins was charged with robbery and rape and sentenced to 10-15 years in prison. He has been in prison for two years to date."said Larry.

"This looks pretty open and shut...You called us out here because of what?" I asked.

"I smelled a rat the minute this case came across my desk.. For one.. The Public defender who pleaded this case out, married the sister of the ADA , one month after Mr. Jenkins began serving his sentence..He then left the Public Defender's office and got a cushy job at a major law firm here...So did the ADA, who is not only a Senior Associate Attorney at said law firm , but is getting ready to make a run for States Attorney...Seems to me that this would constitute a conflict of interest." said Larry.. "You guys did a bang up job with DNA in that case you worked for me a few years ago when my client's DNA was at the scene of a crime.. Tuned out he had a twin brother he had never met, who actually committed the crime.. I need you guys to do this again. I fought hard and I got his conviction overturned and a new trial ordered."said Larry, who was a hell of a litigator himself.. He looked weary and exhausted.. He needed our help. He trusted us.

"Josie and I know a great Independent DNA Lab in Berkeley..."said Beverly.

"Yes...They work fast too! I hope they're still there." said Josie.

"Look them up ladies and call them , set up a meet." said Olivia.

"I'm going to look into this former ADA and his brother in law...Give me a name." I asked.

This is former ADA Sean Cooper, now a Senior Associate Attorney at Fox & Blumenthal Attorneys at Law.

"That would figure...Is she more like Lady Macbeth?" I asked.

Olivia laughed.

Larry laughed at the irony of my joke.

"Liv, I have always loved your husband.." he said, tickled pink.

"I have too! Okay...Neicey Poo, Jo, Bree.. begin the research, read the trial transcripts, research predicates, laws and like cases..."said Olivia.

"On it Auntay!" said Beverly.

"Got'cha Liv" said Josie.

"On it Boss Lady." said Bresha.

"Donnie Ray is going to get a list of the jury pool and do breakdowns on each person within the next few days. Tony, You and I and Nelson are going to weed out who we want and decide on a re-trial strategy..

"I'm on it."said Tony ,pleased to be working with us and even more pleased to be working with his wife, Bresha on a case.

"On it." said Nelson..

"I'm going and get the crime scene reports myself..Bev, Josie, don't forget to call that DNA lab and set something up." said Olivia.

"I'll call the lab right now." said Beverly.

"Liv, I'll go with you tomorrow." I said.

Larry North looked so relaxed.

''When we are going to visit a client in jail, we always take them a tray from Cakeman Raven..It's a big hit." said Beverly.

''I know it is. I love Cakeman..." laughed Larry.. "I'm going to visit my client at San Quentin this morning, so I'll be gone most of the day." said Larry.

''Donnie Ray and I are going to get the Crime Scene Reports and photos and the Sweater the young lady was wearing and the DNA evidence reports."said Olivia.

"While you're there...Can you arrange to get a fresh DNA sample from your client, Saliva, Urine and Semen if you can." I asked.

"You read my mind Donnie Ray, I'm on it." said Larry.

"Auntay, Josie and I called the DNA lab in Richmond..We set up a meeting for tomorrow...So if we can get all of that DNA evidence by today that would be great."said Beverly.

''Bev and I will go out there tomorrow."said Josie.

"I'll drive them out there." said Nelson.

''I found a DNA lab in Daley City..and I set up a meet for the Day after tomorrow."said Tony. "I uh figured that having two seperate opinions builds your argument up. "said Tony Billips.

Bresha smiled at her husband with pride.

"Hey I like this guy's initiative." said Larry. "If Nothing else you know how to pick talent." said Larry.

Olivia smiled.

This same day , a floor down in the Cafeteria.

Teel was having breakfast with her staff.

The three were having Pancakes, Eggs to order, Hash Browns and sausages..

Hot coffee and Orange Juice.

"Don't mind me guys.."I've worked up quite an appetite.." said Teel...Teel loved working in this stylish building, right down the Hallway from her fiance, Larry...She loved helping Wrongfully convicted people get out of jail instead of putting people in jail. Before she got this assignment, she was seriously considering leaving the D.A.'s office and going into the private sector as a defense attorney.

She loved her new staff, Henri, a former Homicide and Organized Crime Detective, Now her investigator and April, a former ADA from Philly with California roots.

''So did We." laughed Henri

''Stoppp it" said April,playfully swatting Henri's arm.. They too had steamed up the windows of his townhouse last night...Henri was as bad as Arthur Tragg, both men got on top of her and seemed like they never wanted to get off of her. She did not want to think of Arthur Tragg.

Private Investigator and former FBI agent, Bert Vandenberg was going to bring those memories crashing back to her..

He walked over to their table and invited himself to sit down..

who once arrested him for interfering with a federal investigation, A Judge who beat the snot out of him for harrassing his girlfriend.. He set them all up..They were caught with other women, their girlfriends got photos of it and broke up with them..One ADA, a woman, had photos delivered to her fiance in D.C.

Their marriage was called off and she lost a job and she tried to commit suicide.. She left town...All the handiwork of Bert Vandenberg, working for my ex. I hated that he used him for that." explained April.

"He's probably going to go back to Philly and tell him he saw me..I don't care...I'm done with Arthur.."said April.

"He's probably working for Sean Cooper." said Henri.

Our doorbell rang.

"Teel, Larry What a nice surprise...Come in." said Olivia.

''He has occassionally investigated us..He does hatchet work for a certain Police Lieutenant we know and for any Attorney who can pay his price." said Beverly.

''So I hear..." said Teel.

"He snapped some photos of Teel and I uh er kissing. He says that since we are involved it is a conflict of interest for me to bring the case before her Wrongful Conviction Unit. He wants us to shut this down or he'll go public with those photos."said Larry.

"You don't have to personally bring the case before the WRONGFUL CONVICTION UNIT..We can!! That's why we are here...And Ms. Teel has another Attorney, ADA April Taylor who can actually hear it."said Nelson.

''What about those pictures?"asked Josie.

"If Neither one of them is presenting the case those photos won't hurt her...You guys are engaged,you live together. It would be a so what item...And he's got no dirt on us personally."said Olivia.

"I happen to know though that a certain Assistant U.S. Attorney in Philly has a real hard on for him...Harrassed him until he left town...How bout I give him a call? He'd be pleased to know Mr. Vandenberg was here in town, making new friends... Paris, feel like making an anonymous call?" I said.
