SAM MOTHER'S DINER- TRIAL DAY

Former Condemned Man, Eugene Grimes sat in Sam Mother's Diner enjoying his breakfast....It felt good eating breakfast in a diner.. Today would have been the day that he was strapped to a gurney and given a lethal cocktail of three chemicals that would have ended his life.....Instead...he was going on trial for murder , still alive and at the present a free man...

He looked up and saw Assistant District Attorney Lloyd Jenson standing over him...

"Enjoying your breakfast convict? You should...because after today...your next meals will be served on Death Row until you're once again ready to get a needle." he snarled.

''Why don't you leave him alone? A Jury will decide where his next meals will be ." said Assistant District Attorney Monique Raye.

"You're on the wrong side little lady....Why don't you go work for the Public Defender's Office?" said Lloyd Jenson.

"I'm on the side of justice, what side are YOU on?" asked Monique.

ADA Lloyd Jenson was shadow training his young protoge' ADA Lisa Rhimes

"I want you to study this case...You're going to present this case next week."he said to her.

ADA Lisa Rhimes was new to the office, a bright young attorney who had won her first 10 cases and had been Lloyd Jenson's second on his last 3 cases...All victories... He had protested this case even being brought up and told that he didn't have to try it , but that he was not to interfere with the attorneys involved.

He decided to use his apprentice to try this case.

He placed his laptop near her...

"These are the attorneys you will be up against." he said.

She studied us...

"ALL RISE FOR THE HONORABLE JUDGE MICHAEL KING. COMMONWEALTH OF PENNSYLVANIA CASE NUMBER 90178, PEOPLE VS. EUGENE GRIMES, The charge,

SEXUAL ASSAULT AND MURDER" said The Bailiff.

Michael King was a tough and fair Judge, but he was not the Judge we wanted on this case... We would have ideally liked Kelly Anne Mercer to be our Judge, but you can't have her for every case...

"Good Morning, Good Morning Attorneys and Potential Jurors....Welcome to my courtroom....We are going to begin with Introduction of the Attorneys...

"Representing the Commonwealth, Assistant District Attorney Lisa Rhimes your honor."

None of us knew her....We expected Lloyd Jenson to prosecute this case.....And here was this woman, a relatively new and unknown Assistant District Attorney trying the case.

"Attorney Karen Page-Benz, Attorney for the Defense your honor." said Karen.

"Attorney Brooke Marks, Attorney for the Defense your honor." said Brooke.

"Attorney Natalie Charles, Attorney for the Defense your honor." said Natalie.

"Attorney David Charles, Attorney for the Defense your honor." I said.

"Attorney Sean Marks, Attorney for the Defense your honor." said Sean Marks.

Monique was not trying the case...She was simply an observer....She was sitting with us and our client,

Eugene Grimes.

''Alright , we will have juror selection..." said Judge King.

The Newbie Lisa Rhimes was good, She had been schooled well in Voir Dire...

but my wife Natalie and her bestie , Brooke were good too and fearless...Not intimidated in the least bit by Lisa Rhimes...They had done research on the jury pool as well and had good questions..

They understood their assignment. They eked out a 7-5 split in our favor, only the second time anybody had gotten such a win over young Lisa Rhimes in court.

This should have been an omen to Lisa that she was in with professionals and this was not going to go like her other cases...This was a case she could lose.

Excellent...We have a Jury......Trial will begin tomorrow morning promptly at 9:00 am..Attorneys and Jurors be on time and be ready for trial.. Court is dismissed." said Judge King.

ADA Lisa Rhimes had the makings of a good Assistant District Attorney.....She was attractive and very articulate.. She knew how to captivate a room and tell a story...

She weaved a tale of a two friends, Who did stick ups together...Dillard Scott and Eugene Grimes as adolescents and who went to the Youth Study Center Together....

Upon release Eugene Grimes , got his GED and began working straight jobs, Light Construction and at a Bar... Here he met Linda Sue Carson, a busty and very flirtatious Bar Maid. The two moved in together and began a very torrid relationship.

Enter Dillard Scott, freshly released from prison...He had served two years of a five year sentence for armed robbery and he was looking for work. He hooked up with his childhood friend, Eugene Grimes and took more than a casual liking to Eugene's girlfriend, Linda Sue Carson... This became a bone of contention between all involved.

Eugene and Linda Sue Carson Broke up and Eugene moved out...She said.. Later, Dillard Scott and Eugene visited Linda Sue one night...The three smoked joint and drank heavily... It turned into a threesome and something went horribly wrong...Linda Sue wound up with a crushed windpipe and a crushed skull and raped..

The evidence was in her body, on her panties and on her bra.. DNA from Scott and another man, Eugene

Grimes...

Karen countered with a story of Eugene Grimes, a man who like the recently executed Dillard Scott had grown up on the mean streets of Kensington and Fishtown and who had turned to crime, Stick Ups as the Assistant District Attorney had said, but who once assigned to the Youth Study Center had made the most of his time, Going to school while there and earning his GED....Mr. Scott on the other hand did not..

When Mr. Grimes was released...He entered Community College and began to work straight jobs, First as a Meat Cutter at a local restaurant and then some light construction and finally in a Bar.

His one time friend and partner in crime, Dillard Scott was arrested and convicted of Burglary and this time sent to an adult prison for two years of a five year sentence.

She stated that Mr. Grimes had no adult criminal record...He was going to school and working.

He moved in with Linda Sue Carson, who was described as very flirtatious and had a reputation of sleeping with or having slept with quite a few of her customers...

She said when Dillard Scott was released from prison, he looked up his old friend, Eugene Grimes and they hung out and bar hopped a bit...Unknown to Mr. Grimes....His old friend was seeing his girlfriend, Linda Sue Carson behind his back... After he discovered this...He broke up with Ms. Carson and moved out.

He was nowhere near Ms. Carson's residence the night she was raped and murdered and in fact, Dillard Scott was there with another man...A Fact brought up in the first trial and never mentioned.

Lisa Rhimes Presented seven witnesses who testified to seeing Eugene Grimes leaving the scene that fateful night.

Natalie and Brooke took their testimonies apart like surgeons... For one thing, the testimony they were giving now and the testimonies they gave at the time of the first trial was vastly different.

One witness was admittedly near sighted and had trouble telling Brooke apart from Karen, Two white women or Natalie apart from Monique, Two Brown skinned African American women from a distance...

Another witness ,it was learned wasn't even at the scene and was repeating hearsay evidence she heard from another witness...

That Third witness had changed her story to the police and then in court in the first trial and then again for this trial, leaving out pertinent facts...

The Fourth Witness had perjured himself in three other trials...

The fifth and six witnesses had changed their story to the police and then had testified differently in the first trial and then again for this trial...It was all apart of public record..

And then the final witness recanted his testimony on the stand, saying he had been jealous of both Eugene and Dillard and had wanted Linda Sue for himself..

They had destroyed Lisa Rhimes case in a matter of days...

Then there was the matter of the DNA Evidence... They had a definite match of Dillard Scott's DNA

in the semen in Linda Sue Carson's vagina, in her panties and saliva on her bra strap and a second man's...Eugene Grimes...

And now we had her....

Sean and I presented experts from the Medical Examiners Office who testified they did a very thorough DNA examination this time of the Rape Kit and found a DNA match for Dillard Scott and another man,

Wardell Warrington, A Black man, an ex-con Dillard Scott met in prison and who had been paroled a few months before him... The Two of them had been drinking buddies. He was the second man who had gone to Linda Sue Carson's house that night... His DNA was in the second man's semen found inside of her.. Apparently she had never agreed to a "Threesome "we theorized and things went sideways...and she was raped by both men and killed by one or the other or both.

We explained that he was never contacted or even questioned for the first trial and after the trial was over, Police searched for him, but never located him...

We told them that before he was executed...Dillard Scott confessed to killing Wardell Warrington and burying him before he and Eugene were arrested...He believed Wardell would've cracked, would have made a deal.

Monique testified that using the confession, She authorized a team to exhume Warrington's remains and supervised the gathering of his DNA....

With that the trial ended and went to the Jury....

Eugene Grimes was more than satisfied with our defense of him...He said it was 100 times superior to his original attorney, who was going through a divorce at times and wasn't 100 percent focused on his defense.

We settled in at our homes after the day was over...

''Wow! We did the damn thing in court today. I'm pretty sure we'll get an acquittal." I said.

"I knowwwwwwwwww!" said Natalie... "Hopefully The Jury thought so too!. That new ADA, she was good, I'll give her that....but she made some rookie mistakes...Like not prepping her witnesses..Like not checking and eliminating the most unreliable ones....I could go on."said Natalie.

"You don't have to" I said as Natalie and I began to kiss..;.

"I've been wanting to kiss you all day.." I said..

"Ummmmmmmmmmmm I know..." she said as the kissing got hotter and steamier.....

I smiled and just stared at Natalie...

Judge King read the verdict and without showing any emotion whatsoever. he passed the verdict to the Bailiff... "Read it " he said.

"Would the defendant and his attorneys please stand." she said.

Eugene stood, his hands were shaking....

Eugene Grimes pumped his fists....

"YESSSSSS! THANK YOU!" he said. Just two days before was the day he would have been executed..

He not only escaped the executioners needle, He escaped the rest of his life in prison..

He was ecstatic as a bailiff took the ankle bracelet off of him..

He hugged Natalie and Brooke and kissed each of them on the cheek..
