One Week after the Brutal "Marcus/Nelson Murders" as the press dubbed them.. 
 

Lt. Tragg made an arrest. He arrested Attorney Harvey Bailey, the partner of the dead attorney...Peter Marcus, his partner and his estranged wife, Felicia Nelson-Bailey.

"Really Lieutenant? Handcuffs....I'm not John Dillinger...I'm a respected Attorney." said Harvey Bailey,.

"Respected?  I don't know about that counselor....Right now you're a suspect in a double murder." said Lt. Tragg.

As reporters and media people snapped photos...

"I am going to hire adequate legal counsel....I am Innocent...I can't wait to have my day in court to address these egregious charges." said Harvey Bailey, ever the performer to the press..

"You! Dummy up....Not another word out of you..." snarled Lt. Tragg, who smiled at the press and said..

''We have made an arrest in the Marcus /Nelson double homicide....A court of law will decide his fate." he said.

Within the next hour, Harvey Bailey found himself in the "Fishbowl" the nickname the detectives had for their interrogation room...His first time there as a defendent....

"MY GOD MAN, THIS ROOM SMELLS GHASTLY!!!.......MY GOOOODNESS!  PEEEEE YOUUU!" snarled Harvey Bailey...

"The Smell of this room is not your concern.... Let's talk about the murders of your partner and your wife..." said Lt. Tragg.

"I'm exercising my right to remain silent.... I would like some coffee though and a phone so I can call an attorney to rep me..." said Harvey Bailey.

"OH WOULD YOU???? HAHAHAHA...THIS AINT THE WALDORF PAL.." laughed Lt. Tragg.

"It certainly doesn't smell like it....!" snarled Harvey Bailey.

"That's been taken care of Mr. Bailey...I have been hired to help with your defense." said Olivia Bennett-Alexander..

"I got them Harvey, they're the best Money could buy..." said Kyra...

"I know... I've heard of Olivia and her team and the big cases they've had over the years....Long time no see Olivia." said Harvey Bailey sheepishly...

He remembered how shoddily he had treated her and young Nelson East years ago..when they were young Public Defenders. 

 He was a little ashamed...She and Nelson had both grown into fine attorneys and were now about to defend him!!! Strange how things turn around... He hoped they didn't hold anything against him.

"Yes it has been a long time...Funny how things change....One day you're taking a case away from me and my associate and writing us off, and years later...Here we are about to defend you...Life is funny isn't it?" said Olivia.

"Touche Olivi!!!... I deserve that!! It really is funny, life's little ironies.... I see you are with your niece and Mr. East is still with you..." said Harvey.

Beverly was a young attorney, just starting out when he encountered Olivia years ago.

And Nelson, her right hand man was fresh out of law school himself.

"Yes... He's married to my niece !" said Olivia.

"OHHHHHH I See!  And you've added some additional pieces.." said Harvey.

"Yes, this is my husband, Donnie Ray Alexander, my principal investigator..

and additional attorneys, Josie Boyd and Bresha Billips." said Olivia,.

"A very formidable legal team. Nice group you have behind you." said Harvey Bailey.

"OH MY GOD!!!!...YOU GUYS LATCH ON TO ANY CASE THAT HAS THE LEAST BIT OF CONTROVERSY ATTACHED TO IT!" said an angry Lt. Tragg..

"We could say the same about you!" said Beverly quietly...

We didn't have to ask him to leave the room...He angrilly left the room and slammed the door.

"Give me a list of people who can vouch for your good charactor...Here write their names and addresses down on this piece of paper...Email Addresses, Phone number the works." said Olivia.

"For the arraignment....Right..Good thinking." said Harvey Bailey.

He began writing names, addresses, email addresses and phone numbers on a sheet of paper..  After he finished, he passed it to me...

"I suppose it's your job to run these people down." he said dryly to me.

I looked at him and smiled.

"I'll check their credibility out as well." I said.

"He's a good man!" said Harvey Bailey.

"Oh he is....In ways you'll never understand. We are not going to discuss anything regarding your case in here....Just sit tight and in two or three days you are going to be arraigned..."said Olivia.

"Good thinking....I like the way you guys operate..."said Harvey Bailey....

''We'll see you in a few." said Olivia. "Come on guys let's go." she said.

We all walked out of the room...

Harvey pulled Kyra to the side..

"They uh don't know who your father is do they?" he asked.

"No they don't!!!...There is no need for them to know... How was his case going?" asked Kyra.

"Both of you are out of your mind!!!....I went to four straight State Appellate Courts and argued his cases and they all turned me down flat...His four convictions stand...I was preparing to argue on his behalf in front of the State Supreme Court when I got arrested and charged with this....I've got to tell you.. His chances don't look good.. The Governor is getting ready to set an execution date soon.... I couldn't even get the death sentences reduced to life..."said Harvey Bailey...

"Well we are going to have to try harder... I'll do some more research in the meanwhile." said Kyra.

"Just get me out of this mess first before I wind up in a cell next to your father..." said Harvey Bailey.

"That's why I got the best money could buy to defend you....Now sit tight." said Kyra....as she left.

Later...We were at home that afternoon.

In our bedroom...

Olivia sat at her laptop.

Olivia liked to know as much about her clients as possible- She sat in bed with her laptop and studied  Mr. Harvey Bailey.

"That Olivia is a shrewd one...Night Court...This is an old trick I used to use to get my clients out..Everyone knows Night Court Judges are a little more lenient.. Well not everyone...If more lawyers knew it, More lawyers would use it ." he whispered to Kyra.

In Philadelphia, Night Court only operates two nights a week....Tuesday and Thursday, Tonight was Tuesday...and fortunately...We got an arraignment date of 8:30 pm. 

The Judge in this case would not be the Judge in the actual case....

Lt. Tragg was not there... He was probably snuggled up with Judge Kelly Ann at her loft...

"OUUUUUU ARTHUR!" she cooed..

"AWWWWW KELLY ANNNNEE!" he moaned..

"OUUUUUU ARTHUR!" she cooed..

As they lie on the bed, kissing like it was going out of style..

Night court was too low profile for him anyway....No witnesses...No media..and a bunch of  Judges  and ADA's who were mostly older Judges and ADA's about to retire...It was lightweight. It was in session from 7:00 pm- 10:00 pm Tuesdays and Thursdays...We were quite fortunate to get a date.

The ADA that did show up was not going to be the ADA that tried the case...He had only the basic out line of the case at hand... He basically wanted to go home...So he didn't really put up much of a fight.

Olivia argued that our client, Attorney Harvey Bailey was a respected officer of the court who had no prior criminal convictions and no history of violence..She argued eloquently that this was a rush to judgement and that he eagerly awaited his day in court to fight these unjust and totally ridiculous charges.

Beverly, Nelson, Josie and Bresha interviewed 12 witnesses a piece....a total of 48 charactor witnesses who testified to his sterling charactor...

And Olivia argued again that he was not a flight risk...

The Judge was impressed with their oral arguments....but because of the severity of the allegations against Harvey he had to set the bail at 1.5 million dollars..

Harvey balked but told the Bail Bondsman to pay it...

The Bail Bondsman only had to put up $250.000.00 dollars, a quarter of a million...

And Harvey Bailey walked out of court a free man.

"Olivia!  You all were excellent if I don't say so myself." he said, beaming.

"YOU GUYS WERE INCREDIBLE!" gushed Kyra.

"Well Thank You Kyra!"said Olivia.

"This is just a small part of the battle." said Beverly.

"Yes...Now we have to prepare his defense." said Nelson.

"And from the looks of things , this won't be easy." said Josie.

"But we can get into that tomorrow..."said Bresha.

"Here is my business card... Go Home, get some rest, shower up....and come see us tomorrow at 11:00 am Okay?" said Olivia.

"Great but I'm hungry.....I know a place...Follow me." said Harvey.

"Lead the way." I said.

Harvey knew of a Rooftop Bar and Grille across town...

"Ummmmmm this place is a well kept secret eh Neicey Poo?" said Olivia.

"It's a great date spot...We've got to come back, eh Nelson?" said Beverly.

"Yeah and tell some of our friends about it." said Nelson.

"Ummmm everything is delish!" said Bresha.

"Yes, this is my first time here too!" said Kyra.

Olivia, Beverly, Nelson ,Bresha and Kyra  decided to have breakfast food.

Pancakes, Breakfast Sausage and Hash Browns...

Harvey decided to treat himself to Steak and Eggs..

He was a man after my own tastes...I ordered a thick juicy steak and an everything omelet also.

Josie was a little more conservative...She ordered a New York Strip Steak too,

But a regular Omelet to go with it..

We all had mimosas with our meals..

A Sweet ending to a nice successful night in court.

IV-

"Olivia, I remember you from High School... I went to Girls High...I was there when you were there.. I was a year ahead of you..."said Kyra.

"Oh Really? Small World!" said Olivia.

"I remember you were on the Swim Team...You won the regional championship and went to the State Championship...the year after I graduated." said Kyra.

"I didn't win the State Championship...So tell me about yourself Kyra...." said Olivia.

''I was adopted...I had very loving foster parents.. They took good care of me..They paid my way through Rosemont College, where I got a B.A. in Education.

I was a schoolteacher for years...I taught Middle School and High School... I didn't get into the law game until about 9 years ago, I went to Lasalle University for Pre-Law...Then  I went to Middleton School of Law in Bayside and got my J.D. there.

Mr. Bailey gave me a job at his firm and he mentored me... He told me to not just take the Pennsylvania Bar, but to take the Bar exams in the region, so I took the New Jersey, Deleware, New York and Maryland Bar exams.." said Kyra.

"I graduated from Middleton School of Law Also...So did my husband." said Bresha.

"You did? Small World?" said Kyra with a smile.

"That's what we all did. I mean as far as taking multiple Bar exams." said Beverly.

''When I met Olivia I had passed the Pennsylvania and New York Bar exams...She talked me into taking the New Jersey and Deleware Bar exams and since then, we've all taken the Bar exams in Texas and California." said Nelson.

"Because you never know where you'll be called to practice..." said Josie.

''And we have practiced in Texas and California over the years." said Bresha.

"I know...I've seen you on the news over the years...You've come a long way since the Public Defenders Office Olivia....Your own practice, Big Career defining cases...You've done well...I'm proud of you..Being a Philadelphian and all." said Harvey.

"Well thank you." said Olivia.

"Is Kyra an Associate Attorney at your firm?" I asked.

"She is...She started out as a Para-Legal while she was in Law School...After she graduated and passed the bar ,she became an associate attorney at my firm...I've mentored her over the years." said Harvey Bailey.

"Life's Little Ironies." said Beverly as we finished our meals..

and ordered coffees.
