Can't Keep A Good Man Down

 TRIAL DAY-  COURTHOUSE WAITING ROOM

"Coffee everybody, come and get it!" said Karen. she had went out and brought hot steaming tumblers of coffee for all of us.

"Oh thank you Karen...."said Brooke.

"Thank You Karen" said her husband, Sean.

"Ouuuuuuuuu thanks." said Natalie...

I had been holding her tight.....

"Thank you Karen..." I said.

"Thanks!" said Henry Luce.

"You ready for this?" I asked.

"Ready as I'll ever be." said Henry Luce, our client.

Assistant District Attorney Alex Rackley sat across from us..

He sipped his coffee...

He poured a flask of Jameson's Irish Whiskey into his coffee.. He smiled...he really looked pleased with himself.

And in the Judges Chambers... Kelly Ann Mercer was in the room with a man, but it wasn't Lt. Tragg and there was no kissing going on...  She was having a long talk with Judge 

"Ralph you're a good man....You should just live your truth....Live your truth and let the chips fall where they may....don't be bullied." said Kelly Ann.

"You're right Kelly Ann...I can't hide who I am and not be in the public spotlight...It's going to come out sooner rather than later." said Judge Ralph Diamond..

"Your wife already knows right?" asked Kelly Anne.

"She's known for about a year now....but I still have a right to my privacy..."said Judge Ralph Diamond.

"But you don't have a right to be bullied, Extorted by that rat, Alex Rackley....I can't stand him..He needs to be taken down a peg and I think the lawyers he's going to face are going to take him down a peg."said Kelly Ann.

"And I'm gonna let em and enjoy every minute of it....He's so cocky, so sure of himself..Thank you Kelly Ann.."said Judge Ralph Diamond..

"You're So welcome Ralph" said Kelly Ann.

COURTROOM D-

''All Rise for the Honorable Judge Ralph Diamond..." said The Bailiff.

"Be seated." said Judge Ralph Diamond.. "Good Morning Attorneys and Perspective Jurors....I am not familliar with all of the attorneys....I am Judge Ralph Diamond... Can we start with introductions...?" he said.

"Assistant District Attorney Alex Rackley." he said...He looked so cocky and pleased with himself.

"Attorney Karen Page-Benz for the Defense your Honor..." said Karen..

"Attorney Natalie Charles for the Defense your honor."said Natalie...

''Attorney Brooke Marks for the defense your honor..." said Brooke.

Alex Rackley  looked at Karen, Natalie and Brooke... He wouldn't mind sleeping with any of them under different circumstances...

"David Charles, Attorney for the Defense ." I said.

"Sean Marks, Attorney for the defense." said Sean..

"Mannn, he's got Brooke? Lucky guy...I know she drives him wild in bed." Thought Alex Rackley...

Our client, Henry Luce stared daggers at Alex Rackley, the man who sent him up....It was all he could do not to rush over and pound him into oblivion...and thus earn a real murder one conviction.

''Alright, we'll now juror selection." said Judge Diamond.

Alex Rackley ,so sure of himself fielded softball questions to the jury pool..He hadn't bothered to research the jury pool...

Natalie and Brooke had thoroughly researched the jury pool with help from Nelson , Keith Jones and Kahlil... Voir Dire experts

They got a perfect 12-0 score...Getting all 12 jurors they wanted!

"Outstanding....We have a jury.....The trial will begin promptly tomorrow morning at 9:00 am, Attorneys and Jurors remember to be here on time and be ready for trial." said the Judge....

Alex whispered to the Judge...

"Remember....We have a deal Ralphie! Heh Heh Heh!" he laughed.

"Get Away from me you scoundrel!" snarled Judge Diamond.

At home after our day in court...

"You and Brooke were on fire....I couldn't believe it...You got all 12 of the jurors we wanted...I hadn't counted on that." I said, smiling and unzippering her dress...

"I didn't either....Not all 12....Rackley is reckless...cocky, like he's got an ace in the hole..."said Natalie.

"Like a Judge?" I asked...

"Yeah or something..Like he knows something we don't know..."said Natalie..

"Don't worry baby...There is only so much a Judge can do when confronted with facts....Even Judge Wilson could do so much against Olivia and Beverly and their team and Yvette and her guys....and the Public Defender in the trial Sean was involved in...and he was the most corrupt kneecapping Judge there was...He made an art form out of it...and they beat him..."I said.

"You're so good at finding a silver lining in things.." said Natalie..

She gave me a long slow kiss....

a kiss that got hotter, more smouldering....

"Is there a Silver lining in your panties?" I asked..

With ADA Alex Rackley laying out some outlandish claims....

Leading to Brooke and Natalie objecting at least 31 times...

Alex Rackley looked surprised and stared at the Judge..

He called his three witnesses from the first trial....

On Cross, Karen and I compared what they said three years ago to what they were saying now , according to affadavits..

Alex Rackley objected....accused of badgering the witnesses...

Again Judge Diamond upheld Me and Karen's questions and made his witnesses admit that their testimony from three years ago was tainted...

Alex Rackley was livid and it was showing....

He showed the jury lurid photos of the crime scene.....

Sean called Police and Crime Scene Investigators who were at the original crime scene who stated that neither Henry Luce's DNA nor fingerprints were ever found at the crime scene.

The Next day...

Natalie presented People from Dr. Goggins Independent Lab who had DNA Evidence taken from Henry Luce and compared it to the DNA evidence taken from the original crime scene that from  here to for had never been mentioned or seen by the jury in the first trial...Their conclusion was that the assailant was someone else other than Henry Luce.

Alex Rackley bitterly complained and argued that this should not have been presented since it wasn't used in the first trial.

Judge Diamond argued that was exactly why it is being heard in this trial...

Brooke and Karen presented FBI Lab Technicians who had also sampled fresh DNA from Henry Luce and compared it to DNA and Fingerprints from the original crime scene...Their conclusion was that the assailant was someone else other than Henry Luce.

I presented People from our own Medical Examiners Office, who had their copy of the original crime scene photos and report...as well as the DNA and prints from the scene, never presented as evidence...

Alex Rackley like his case was falling apart...

Brooke and Natalie presented five witnesses...Five witnesses who were never called to testify , five witnesses who the original attorney begged to be allowed to testify and who Judge James Wilson denied their testimony, claiming it "was irrelevant"

These witnesses placed Henry Luce, miles away from the crime scene during the time of he murder...

Alex Rackley went hard on each of them on cross..

Sean and I accused him of badgering the witness and of being argumentive...

Judge Diamond agreed....

Alex Rackley was livid....He looked at the Judge as if he had betrayed him....He tossed his suit jacket up into the air and kicked at the table...Until he was ordered to sit down... He sat down and crossed his arms like a small child.

He and Karen did their sumnations...

and the case went to the jury....It was Thursday Afternoon.....

Alex Rackley whispered in the Judges ear...

"You're Toast Buddy...TOAST!" he snarled...

When he went to his safe deposit box that afternoon...He found His envelope with the incriminating photos and the negatives were gone!!!!!

"WHATTTTTTTTTTTTT?" he exclaimed....

And at the offices of Morris Communications and Investigations..

"Mr. Morris....I can't thank you enough for what you and your operatives did."said Judge Diamond.

''We followed him for three days....then one of my operatives who specializes in this type of thing opened his safe deposit box and retrieved the envelope and the negatives..."said Private Investigator Kevin Morris.

"Here they are,..do with them what you will." said Kevin.

"I'm going to burn them....He thought he could bully me into throwing a trial his way.... I was not going to be bullied." said Judge Diamond.

"You're a good man and you can't keep a good man down." said Kevin.

IV-

COURTROOM D- FRIDAY MORNING!

"ALL RISE FOR THE HONORABLE JUDGE RALPH DIAMOND-" said the Bailiff....

"ALL RISE!  Jury Foreman Have you all reached a decision????

"We have your honor." said the Jury Forewoman...

She passed the decision to the Bailiff..

The Bailiff passed the decision to the Judge...

He read it and smiled...

"Read it Bailiff." he said.

"IN THE MATTER OF COMMONWEALTH OF PENNSYLVANIA  vs. Henry Lee Luce  on the Charge of Murder in the First Degree...We find the defendant ,NOT GUILTY!

"YOU GUYS WERE FOR REAL, THANK YOU! THANK YOU ALL SO MUCH!" said a Jubilant Henry Lee Luce!

"It was a pleasure to represent you.."said Karen..

''Always a pleasure to get an Innocent Man off."said Brooke.

"Good Luck man!" said Sean...

Henry looked over at me and Natalie.

"Looks like those two started celebrating early."said Henry.

We were in the corner kissing passionately......

Karen laughed...

"Maybe they need a room.." laughed Karen...

"Yeah, exactly."laughed Brooke...

Alex Rackley was inconsolable....He left the courthouse in tears..

We looked at 53 cases and found 26 cases to be fraudulent....We got 26 people who were wrongfully convicted released from custody just like Henry Lee Luce...

Alex Rackley was censored for withholding evidence in cases and jury tampering as well as willful knowledge of Obstruction of Justice before the Legal Ethics Board and eventually disbarred.. He actually served some jail time... Incredulously just FIVE DAYS...and was eventually released...

Today he is the host of conservative leaning Podcast...

Judge Ralph Diamond got a little bit of revenge...Proving...You can't keep a good man down!!!

We were all there on a Friday Night, having drinks and celebrating...

"Welllll some of our friends are going to be up for the Super Lawyers award, due to all of that work you did on getting those ,what was it 29 Wrongfully Convicted people released from prison."said Jazzy.
 

"That clown Rackley was just piling up win after win...using Judge Wilson and Lt. Clarke to help him pad his tally...."said Dabnis with disgust.

"I am just amazed so many innocent people went to jail..."said Kayla.

"It happens all the time..They don't have money to hire top flight legal counsel, they get stuck with some poor green Public defender and a bully of a seasoned prosecutor and they lose their early cases before they get hip and learn the game."said Ray.

"It happened to me when I was a young attorney...That's why I fight so hard now.."said Jessica.

"She took me under her wing and taught me the ropes."said Chip.

"That's why I fight so hard for my clients..and why I hate guys like Rackley....Opportunistic Bullies."said Karen.

''Something about the whole thing sounded kind of personal."said Lem.

"That's what I'm thinking...He had his entire case load investigated..."said Renee.

"Well after fumbling three straight cases, I figure they had to look at all of them."said Tyrell.

"He was looking to run for District Attorney.." said Lee.

"I heard he was considering a Judgeship." said Matthew..

"Well all of that is kaput now...He's been disbarred."said Nina.

"As he should've been." said Carlos. 

"I heard a rumor he had some sensitive information on Judge Diamond and was extorting him."said Olivia.

 

"Probably wanted him to throw the case." said Donnie Ray.

"But the Judge didn't fold..."said Beverly.

"And I haven't heard or seen anything untoward about the Judge....Wonder what happened?" asked Nelson.

'Somehow or other the Judge got ahold of whatever evidence he had against him if he ever had any and one upped him."said Josie.

"I don't think he had any or he would've used it..."said Paris.

"Still the way the Judge went after his cases did seem kind of personal."said Bresha.

"Well he fumbled three straight cases...You had to look at the rest..."said Tony..

"Turns out, a good many of them were fraudulent..."said Alfreda.

"He was trying to pad his winning percentage. I hate ADA's like that."said Rockland. 

 

 More Drinks and Shrimp and Chicken baskets arrived....

 " Ole Rackley is on the radio, Whining about he was wronged by Left Wing Bleeding Heart Attorneys."said Yvette.

"I'm sure he'll find a small audience for his whining."said Gary.....

"I'm sure he misses being an Assistant District Attorney and lording it over people." said Keith Jones.

"He no longer has his partners in crime.."said Bee Bee.

"Yeah Lt. Clarke is dead and Judge Wilson is on Death Row..."said Sofia.

"Yeah we cleaned out some real scum lately..." said Kahlil.

"I was proud to be a part of it.."said Jade.

"I'm proud of all of you guys that took part in those cases."said Danny Ho.

"I am too!"said Virginia.

"With Wilson off the bench and Clarke Dead..and Rackley out of court...I wonder if there are any more scallawags lurking around the court system...

Natalie looked at me...

"That is a sobering thought!" she said.
