VENTURES: Moral Support

We had a bakery /coffee shop just a few door down from us on our block.. It wasn't Cakeman Raven's, but it would do...

Natalie and Brooke got Bagels and Cream Cheese and Jelly and Doughnuts...

while Sean and I filled up Thermos's full of Hot Coffee, and got creamers and Sugar.

With that done.....

We got in my wife's Blue Nissan Versa and headed toward the Prison.

Alex Rackley had a court date this morning, so he couldn't follow us or spy on us...

By the time he got to the Bridge Building....None of us were there...

Unknown to him...Karen was arguing at State Appellate Court for Henry Luce's sentence to be tossed aside..

She wasn't alone- Olivia Bennett-Alexander and Yvette Jones-Lockwood, her closest friends from law school and now contemporaries were with her for Moral Support. Also with her was the Jessica Sanchez-Burrows of the Innocence Project. They had turned today into a Girls Trip.

"Thank you girls for coming along." said Karen.

"Anything to get out of the office." laughed Olivia,

"We haven't hung out, just us three in a long time."laughed Yvette.

''Wowwww...you guys really have a history together." laughed Jessica.

"Olivia and I were room-mates...and we lived across the hall from Karen, who was always coming to our room to study or borrow something or to vent....We kind of took a liking to her..."said Yvette.

"First she was a nuisance...Then by the end of our first year, she became our friend, our sister...."said Olivia.

"We studied for and took the Bar exam together and passed and got sworn in the same day..."said Karen.

"Oh Wowwwwwwww!"laughed Jessica, who had worked cases with all three of these women and who lived on the same block with all of them.

Olivia , Yvette and Jessica sat in the visitors section while

Karen argued before Judge John Bartlett.

She had argued before him not long ago....

She argued that Henry Luce 's trials had a lot of mistakes.... She brought up five witnesses who could place him somewhere else during the time the crime was committed who were never called to testify and who appeared too frightened to testify... She brought up that DNA evidence and fingerprints taken from the body and the scene of the crime mysteriously vanished and was never told to the jury and other exculpatory evidence.. She stopped short of saying prosecutorial misconduct although it was quite evident..

He heard Karen's oral arguments for close to FOUR HOURS!

He agreed to overturn Henry Luce's conviction...and ordered a new trial for him in Philadelphia immediately....

"This Detective, This Lt. Arthur Clarke....His name keeps coming up in a number of these cases....Is he still on the force?" asked Judge Bartlett.

"No Sir...he was fired recently and tried and convicted of Obstruction of Justice and Jury tampering...Unfortunately before he was to serve his sentence...He took his life..." said Karen..

"So he's dead! GOOD!" said Judge Bartlett..

Olivia, Jessica and Yvette broke out into laughter.....

They found an old fashioned Malt Shoppe ,where they had Banana Splits afterwords.

"Mmmmmmmmm these are soooooo good." said Jessica.

"I can't thank you guys enough for coming with me...."said Karen..

"Will you stop thanking us Karen...We are your friends...Your besties....Of course we were coming to give you moral support.."said Olivia..

"And to be treated to these wonderful Banana Splits.....mmmmmmm"said Yvette..

All four women broke into raucous laughter....

II-

We requested and got a big visiting room for Attorneys and the prisoner.

Henry Luce was actually surprised to see us and even more surprised to see that we brought Coffee and food..

"Oh Wowww! Coffee, Bagels and Cream Cheese, Doughnuts and O.J. Nice! You know I'm a New Yorker by birth and we used to have the best bagels .." he exclaimed.

"There's a Bakery and Coffee shop at the bottom of the block where we live...So we stopped by there before we came here." said Brooke.

"You guys live on the same block?" asked Henry Incredulously...

"Yup, next door to each other..."said Natalie..

"And our boss lady who you haven't met yet ,lives across the street and in the next block from us." I said.

"You guys keep it close huh?" Henry laughed as he sipped his coffee and munched on a bagel.

"Oh By the way...Our Boss Lady, Karen Page-Benz is arguing your case before the State Appellate Court as we speak...She's trying to get your conviction tossed out and a new trial ordered for you."said Sean.

"Ohhh wowww! You guys weren't kidding." said Henry...

Natalie's phone went off...

"GREAT NEWS FOR YOU! KAREN JUST TEXTED ME...YOUR CONVICTION HAS BEEN TOSSED OUT AND A NEW TRIAL HAS BEEN ORDERED FOR YOU!!! "said Natalie.

"WHAT? WHAT DOES THIS MEAN?" asked Henry Luce...

"It means you're going to be leaving here today....You'll be transferred to the Philadelphia Men's Correctional Center to await a new trial date."said Brooke.

"Since you're not a convicted criminal anymore...That means you'll be eligible for arraignment..."I said.

"We are going to try and get you arraigned as quickly as possible....You got any friends, any former work colleagues who can vouch for your charactor?" asked Sean.

"I've got a few..." said Henry, smiling broadly....

"Good! Then we'll see you in a few days then." said Natalie.

"You kids are alright!" Laughed Henry.

THAT NIGHT!

"What a great day....We had a good meeting with our client and Boss lady did her thing in Appellate Court." said Natalie.

"She Sure Did! And hey, Old Rackley had no clue where we all were."" I said.

"He'll know soon enough...I hope we can run Henry through Night Court before he gets wind of it."said Natalie..

"Yeah..We've got to work smart and fast."I said.

NIGHT COURT- FOUR DAYS LATER-

We got Henry Luce an arraignment date in Night Court just three days after we saw him last...

In Philadelphia, Night Court only operates two nights a week....Tuesday and Thursday, Tonight was Thursday...and fortunately...We got an arraignment date of 8:00 pm.

The Judge in this case would not be the Judge in the actual case....

Lt. Tragg was not there... Night court was too low profile for him...No witnesses...No media..and a bunch of Judges and ADA's who were mostly older Judges and ADA's about to retire...He had nothing to do with this case...Alex Rackley was fortunately for us....Not here either. It was lightweight. It was in session from 7:00 pm- 10:00 pm Tuesdays and Thursdays...We were quite fortunate to get a date.

The ADA that did show up was not going to be the ADA that tried the case...He had only the basic out line of the case at hand... He basically wanted to go home...So he didn't really put up much of a fight.

We presented 10 charactor witnesses , Five personal friends, five people he used to work with...We were lucky to have located all of them.

Henry had no priors...This helped him immensely....He was released on his own recognizance..without bail..and surprisingly without having to wear an ankle monitor..

A Free man after three years ,awaiting trial, he was ecstatic!

"I can't believe it...You guys were serious when you came to see me.. It's been two weeks and I'm a free man!" he said...

"We are still going to have to go through another trial.....but until your retrial date comes up...Enjoy life, just keep a low profile...I don't have to tell you that."said Karen..

"At last we meet....Thank you for all you and these kids did for me...Thank you so much."said Henry..

"You are so welcome....This is my business card and my phone number....Come see us tomorrow, we have some things for you..."said Karen..

"Do you have some place to stay tonight?" asked Brooke.

"I have some friends...I can stay with them....You guys are down by the riverfront...Penns Landing eh?" said Henry...

"Yeah we are." I said.

"Good, I'll meet you guys in the morning..." said Henry....

"Get some rest Henry..." said Natalie...

"Yeah man, get some rest!" said Sean....

An Uber pulled up!

"That's me....Thanks again guys..." said Henry as he waved goodbye..

"You guys hungry?" asked Karen..

"Yeah...let's go to Jakes." I said.

"I haven't had one of his good hot dogs in a minute.."said Sean.

"Ouuuuuu me neither...."said Natalie.

"What is this place, Jakes?" asked Brooke..

She was the only one of us who had never been there...

"Oh My God Brookie...You've never been to Jakes? It's close to home and they make the best Hot Dogs you've ever had..."said Karen.

"Well what are we waiting for?...Let's go!" said Brooke.

We drove over to Jakes...Where we were treated to the best hot dogs money could buy.....

and Cokes....

"I can't believe you guys didn't tell me about this place before..."said Brooke.

"I thought I had brought you here before.."said Sean..

"I could have sworn me and you came here when we were hanging out..."said Natalie..

"That was me...You brought me here for the first time." I said to Natalie.

''Well aren't you glad you're here now Brookie?" asked Karen...

"I sure am." said Brooke smiling...

Sean took a napkin and wiped the mustard off of her lips....

A Nice way to end a great day!

THE BRIDGE BUILDING-

OUR CONFERENCE ROOM-

"Nice Joint you guys got here..." said Henry Luce as he walked into our conference room and sat down..

"Can I get you some coffee?" asked Karen..

"Please, thank you." said Henry...

"We took fresh DNA and prints from you , while you were in Phoenixville...The girls are going to take that to an independent DNA lab, The FBI DNA lab and our own Medical examiner's office...Where it can be compared to the original crime scene report.." I said.

"The Original Crime Scene report vanished." said Henry.

"We've got a very good investigator searching for it... He used to be a cop..A Lieutenant in the Robbery-Homicide Unit...Now he's an investigator for the D.A.'s Office." said Sean...

Brooke passed him a burner phone.

"This is a burner phone and this is the number....If you need to contact us, don't call our personal numbers or our business numbers...Call this number...It's untraceable....We have a strong reason we are being watched and monitored by the Assistant District Attorney who sent you up..Alex Rackley.." said Brooke.

"That Rotten Son of a bitch." said Henry...

''Well this way...he won't be privy to what we are doing... This here is a Portal.. I'll show you how to use it."said Natalie.

"With this, you can keep abreast of the progress we are making on your case..." said Natalie.

"WOWWW! You guys cover all of the bases.." laughed Henry Luce...

Karen passed Henry a cup of coffee...

"We got you covered." she assured him. He believed her.

FRIDAY NIGHT- THE NO I.D. BAR-

We were all at our Friday Night watefring hole...The No I.D. Bar, right across the street from where most of us worked...

"Nothing like this spot after a long week..." said Jazzy.

"Yeah, even though this week nobody was in court...We handled everything virtually..." said Dabnis.

"Same here...but I'm mentally tired." said Kayla.

"Indeed, so am I, pass me some shrimp!" said her husband, Ray.

"This was a nice mellow week."said Jessica.

"Yeah you guys all got to hang out, Olivia. Karen and Yvette.

"It was fun...A regular girls trip." said Karen.

"They were there for Moral support and that was truly a good thing..." said her husband, B.L., who was holding her on his lap.

"This has been a good week..We got a lot accomplished."said Natalie.

"Yeah , we did a good job of staying away from Rackley.." I said.

"I heard he was by our office the day Karen was at the State Appellate Court and we were at the prison." said Brooke.

''And no one in our building would talk to him....Most of our friends had no idea where we were anyway."said Sean.

"He sat across the street from your homes until I guess he got tired and he drove off."said Zoey.

"He had to know that we saw him." said Lem..

"He was walking around the hallways in the building that day, totally frustrated that none of you guys were there." said Renee.

"Then he stood outside and watched us as we left to go home..." said Tyrell.

"Yeah now surprisingly enough, Today when you guys were here...He was nowhere to be found."said Lee.

"He's probably had to do something called work...Like appear in court."laughed Matthew...

"Yeah probably...It was nice, not seeing him today." said Nina.

"He is really upset about you guys overturning two of his cases and I think he fears you overturning a third case." said Carlos.

Two Shrimp Baskets came to our table...

and fried chicken as well..

"I think that if three of his cases are overturned and this fast and for the same reason, he could be censored."said Yvette.

"You're absolutely right...ADA's win and lose cases everyday....but in the two cases you guys overturned.. Prosecutorial misconduct was mentioned in both and in both cases, key evidence was missing, witnesses were intimidated or just plain not called..."said Gary.

''That's right and a third case coming up with this mention would call for him to be investigated and or censored." said Keith Jones.

"He might even be fired...."said Bee Bee.

"None of that looks good on his record, especially since he has his eye on running for District Attorney in a year or even higher office."said Sofia.

"He's feeling the heat..he needed to know which one of his cases was being looked at."said Kahlil.

''A third case could call all of his cases to be looked at."said Jade.

"I think he knows that the Henry Luce case is the one being looked at." said Danny Ho.

"It was on the news that his conviction was tossed out and that he was released on arraignment two days ago." said Virginia.

"He's worried...he'll be censored..." said Jetty.

"He should be censored.." said Olivia.

"They might reopen all of his cases.." said Donnie Ray.

"That wouldn't be a good thing for him." said Beverly.

"No, Not at all." laughed Nelson.

"The real shame is that Lt. Arthur Clarke isn't around to face the heat." said Josie.

"He did....He was convicted of witness intimidation and tampering and Obstruction of Justice and sentenced to 5-10 years... He was fired remember?" said her husband, Paris.
