Brittany Hughes gave her opening argument stating the plain facts... Della Avenue waited outside of the Aqua Bar where she worked and shot Daniel Ballinger at point blank range six times..This was not in dispute...She dropped the murder weapon and stood there waiting for the police to arrive...

"She had been sexually assaulted by Mr. Ballinger and she had reported it and had a rape kit done.. but whether she had been assaulted or not...She should have waited for the police to handle the situation..This did not give her the right to be judge jury and executioner.." she said..

Ms Yvette's opening argument appealed to our jurors... She said that Ms. Avenue had been raped and had been called and harrassed and threatened by her rapist and was in a state of extreme emotional distress..and that this led her to make the fateful decision to kill her attacker , who brazenly returned to Aqua Bar, perhaps to seek another victim...

And thus the battle began..

For the next four days, Brittany brought Policemen on the scene, Forensics Specialists, and crime scene investigators....

Their testimony was unimpeachable..We all knew what had happened..Then she brought forth 20 witnessess..

She prepared them well because she knew,

Bee Bee and Sofia had studied their witness statements...The ones they made to Lt. Tragg, the ones they made to Jade.

and what they were saying now...

She knew they were going to disect their testimony completely and they did...but thewitnesses rarely wavered...

This indeed was not going to be an easy case...

By the time Brittany made her closing arguments...

The Jury was 11 to convict and 1 undecided.....That did not look good for us...we had to change their minds...

"We weren't able to put a dent in those witnesses statements at all."said Sofia.

''Well they saw what they saw."said Kahlil.

"Look I'm guilty....I shot him, they all saw me do it...They aren't lying.."said Della.

''And they haven't heard our side yet...They have to be presented with a different perspective.."said Ms. Yvette..

And speaking of a different perspective..

Bee Bee showed the jury a photo of Daniel Ballinger , A six foot three, 240 pound man...She noted that

Della Avenue was five feet even and 135 pounds..A very petite woman... He overpowered her and raped her..

She presented 24 witnesses from Aqua Bar, who heard her screams and who called the police that night..

We had prepared our witnesses too..

On Cross, Brittany couldn't shake them...and her protests were met by Bee Bee brilliantly citing previous cases and precedents excellently...

Judge King had to rule in Bee Bee's favor ,even though he clearly didn't want to..

Yvette looked on proudly..

Sofia produced the semen stained panties, The saliva stained bra worn by Della that night and the results of the rape kit, plus the DNA match to Daniel Ballinger from the Autopsy report that proved he was indeed the rapist....

I called the two women who he raped...One who testified about him in court and got him convicted and the other who was frightened ,too frightened because of his calls and his stalking.. I presented the phone records of both women as proof that this man bullied these women, one so much that she dropped the charges against him..

I presented witnesses who had been told by both women about Daniel Ballinger and the restraining orders brought against him as well as two policemen who had arrested him and tried unsuccessfully to have him put away again.

Kahlil presented three nurses who did the rape kit on Della , who stated her mental state at the time of the rape..

They said she was very distraught...

Brittany on cross asked each Nurse if she was a psychologist...Two said no....She said that she was not qualified to make that kind of judgement.. But the third Nurse was indeed a Clinical Psychologist and did indeed decide that she was distraught...

Yvette presented the phone records from Della's phone showing that Daniel Ballinger called Della eight times on the night of the rape...Four times when she was in the hospital...She didn't deny that Della killed him and she said..She was not advocating vigilantism, but society failed to protect her and she wasn't going to be rid of him anytime soon...He may have even tried to rape her again...He didn't like taking no for an answer...

It was a great close and the jury was shifted to 10 to acquit, 2 undecided...

ONE WEEK LATER-

We were back in court for the verdict...

"You guys did a fantastic job, No matter what happens now...I'm good with it." said Della.

Yvette was anxious...She hadn't had a good night sleep all week after the trial.

She had told her client and her associates to have faith and not to worry and now she wasn't sure.

Bee Bee, Sofia, Myself, Kahlil and Jade all stood anxiously, hoping and praying we got an acquittal.

ADA Brittany Hughes didn't look like she felt good at all...

Lt. Tragg looked confident...There was no way he figured this jury could not give any other verdict but guilty...

Nona Avenue was nervous...She was quite pleased with the defense we had put up...and she told us that.

Her sister, Patty who had hired us also told us she was pleased with the job we did..

We had practiced in Patty's husband, Judge Percy Reynold's court a number of times...He knew us...He thought that "What I saw was the best lawyering ever."

"Mr. Foreman have you come to a decision?" asked Judge King..

"No your honor...We Are Hopelessly deadlocked 10 to acquit and 1 to convict and 1 undecided.." said the Foreman...

ADA Brittany Hughes stood up-

"Your Honor, in the interest of Justice, The People do not wish to pursue any further prosecution

of this woman..She was obviously the victim here...The people drop all charges against this woman." she said.

''So Be It! Ms. Avenue, you are free to go...But I suggest you get some Therapy." said Judge King.

Della burst into tears....

"Yes Your Honor, I will!!...Thank You Your Honor!!! Oh My God! I thought I was going to jail for the rest of my life...I just knew I was, Ms. Yvette, You kept saying to hold on...You were right...Oh Thank you so much..Thank you so much..." she said. She hugged Ms. Yvette and each and every one of us on her defense team.

"I told you to have faith..I told you to hang on.."said Yvette..

"Wowww we really bit the bullet with this one. But see? We got you off" I said.
