Fate Of Cousins

 It was a very rainy Friday Morning...With a little thunder and lightning...Could be an omen, could not be..

Beverly  and Nelson were drenched when they ran in the courthouse with coffees for all of us...

"Ouu thanks...It's pouring out there...No lipstick smudges on your collar Nelson, Guess you didn't have time to kiss my niece huh?" joked Olivia.

"Wasn't a big line today.." said Nelson, smiling as they passed coffee to everybody.

"Thanks Guy." said our client, ADA Joshua Hoffman...

He kept calling Gretchen Bondi...he had heard that a judge had dropped all charges against her...He hadn't heard from or seen her since... but we had...Last night to be exact..

In a Tony New Taco Bar and Restaurant we had discovered..

with a young man, enjoying Tacos and Quiet conversation.

We all sat huddled in the courtroom waiting area for the trial to begin...Drinking Coffee and talking amongst ourselves. 

"We've got an aggressive defense prepared for you...but we are hoping that the Judge will drop the charges on you just as charges were dropped on Gretchen Bondi."said Olivia.

 

"This case is extremely weak and circumstantial..  If I was still a Homicide Detective...I wouldn't have even charged you or her once I found out a fourth , here to for unknown person was in the room."I said.

"Well, you know his name, Sergey Mogolovich...Apparently he's skipped town." said Josh Hoffman.

"And Since he hasn't been charged with anything...There is no reason for any police agency to look into him." said Beverly,

"If Any other detective other than Tragg was involved, we wouldn't even be here... His cousin ,Arthur Tragg is the absolute worst...I'm glad he's off the street."scoffed Joshua Hoffman,.

"Yeah, he's on the boat indefinitely..."said Nelson.

"When you guys went to see H.Stanley Stanlison...was Gretchen there?" asked Josh Hoffman.

"No she wasn't." said Josie.

"He's got her holed up somewhere."said Bresha.

"I called her and uh we went out for drinks in Bayside about a week ago....I haven't seen her since., have any of you?" asked Josh Hoffman.

None of us wanted to tell him we had seen her with another man last night at a Tony Taco Bar we all happened to be in. 

"Josh, focus on the trial at hand."said Olivia.

 

"Yeah, she's been exonerated..."I added.

''She's probably taking on a case right at this minute."added Beverly.

"Yeah and maybe this time next week..You will be too." added Nelson.

"Oh Look..It's the media." said Josie.

"We've finished our coffee...Let's go inside."said Bresha.

The Press flooded the courtroom waiting area...They wanted to ask us questions...but we all said "no comment" and walked away..

Special Prosecutor, Larry Peppers arrived at just that minute.. Like Lt. Tragg and Jumpshot Jim, he appeared to like the spotlight.

"It's a very unfortunate situation and I hope we can get to the truth about what happened that night."he said.  "No More Questions Boys." he said, Smiling and entering the courtroom behind us..

II-

COURTROOM A- 9:00 AM FRIDAY MORNING

The Judge ,Telma Bailey was the same Judge we had just tried our most recent case with....Ironically

Joshua Hoffman was the Assistant District Attorney in the case...Now he was the defendent..

"Oh No...This Judge hates me." said Josh Hoffman...

"ALL RISE FOR THE HONORABLE JUDGE TELMA BAILEY" said the Bailiff.

"Be seated." said Judge Bailey.

"We are in luck..She's a good Judge." said Olivia.

 

''Well one thing has broke our way." I said.

"I like her....Plus she's a soror..."said Beverly...

"Hopefully...that will help us." whispered Nelson.

"I like her."said Josie.

"I do too!"said Bresha.

"Glad you guys do...She hates me...I've tried two cases in her court before, not including yours." said Joshua Hoffman.

"Be Seated.....Good Morning...Good Morning.....I am Judge Telma Bailey..We are going to seat a jury today and trial will start tomorrow morning...I believe I know most of the attorneys involved...Except for one..but would you introduce yourselves anyway to the court please?" she said.

"I'm Special Prosecutor Larry Peppers from out of New York City your honor." said Larry Peppers.

"Ohhhhhhh! Well I hope you enjoy our city while you are here."said Judge Bailey.

"I have been...In fact I am thinking about moving here." he said.

"Oh how nice." said Judge Bailey. 

 "Olivia Bennett-Alexander, Attorney for the Defense your honor." said Olivia.

"Beverly West-East, Attorney for the Defense your honor."said Beverly.

"Nelson East, Attorney for the Defense your honor." said Nelson.

"You two are married right?" asked Judge Bailey.

"Yes your honor."said Beverly smiling.

"That's so cute."said Judge Bailey.

"Josephine Boyd, attorney for the defense your honor." said Josie.

"Bresha Billips, Attorney for the defense." said Bresha.

"Amazing how you work around such beautiful women all day, every day."said Joshua Hoffman.

I just smiled.

''Alright, we'll have Jury selection."said Judge Bailey.

 

Nelson was primed for jury selection.... He had studied all of the jurors..He knew what jurors he wanted and what jurors he did not want.

Larry Peppers had experience with Jury selection...He even came with good questions..

He was not prepared for the help Nelson was getting from Josie and Bresha , who were on their laptops

feeding him questions for certain jurors...

Nelson steam rolled to a 11-1 lead, including the jury foreman..a tremendous lead.

Olivia was ecstatic!!!

"Excellent!  We now have a jury....Have a Great Weekend.Trial will begin promptly Monday morning here at 9:00 am.

Attorneys and Jurors be on time and be ready for trial." said Judge Bailey as we all left the courtroom.

From a distance...We saw Gretchen Bondi and her male friend from the night before.

She walked out of another courtroom...

Her young male friend from the night before was waiting for her..  They smiled at each other..

They kissed each other and walked off hand in hand...Not even looking our way...

Joshua Hoffman looked devestated... He was in this situation because of his relationship with her...He now wondered if it was all worth it.

TENDER IS THE NIGHT-

That Night at our home..

"I'm glad we have the weekend off before trial.."said Olivia.

"Yes...We have time to rest up and work off a little tension." I whispered softly...

Special Prosecutor Jerry Peppers was good , damn good. He weaved a story about a wild night of HEDONISM....Joshua Hoffman, a celebrated and seasoned Assistant District Attorney and married man

went astray and went to a hotel room with a young woman he had met in this very courtroom and another young woman and had a wild night of Hedonism, Drinking Beer, Smoking huge amounts of Marijuana and sexual intercourse with the young woman he met in this courtroom. (He never mentioned Attorney Gretchen Bondi's name) and the deceased Valentina Natchios.

He said that somewhere in the night, things got out of hand and Joshua Hoffman strangled Valentina Natchios.

He didn't present a lot of evidence...A few people who saw them enter the Hotel testified....

Beverly and Olivia got them to admit that there was a fourth person with them.A here to for unmentioned  Sergey Mogolovich...

Special Prosecutor Peppers tried to get this testimony stricken.

Nelson and Bresha argued that this was relevant to our defense..

Judge Bailey allowed the testimony....

Special Prosecutor Peppers looked at Detective Tragg angrilly.

"YOU SHOULD HAVE BEEN ON TOP OF THIS....I TOLD YOU I DIDN'T WANT ANY SURPRISES!" he bellowed.

Like Lt. Tragg, Detective Tragg looked like he had swallowed a canary.

We began our defense with Olivia saying that what was supposed to be a "Threesome " became a "Foursome"...

Beverly and Josie called several members of the Crime Scene Investigation team who testified that they discovered DNA and Fingerprints belonging to a fourth person...as well as semen of two men in both women...One being Joshua Hoffman and the other belonging to Sergey Mogolovich....a low level hood.

Nelson and I pulled out a 48 inch monitor with a photo of Sergey's mug shot on it for the Jury to see.

Bresha called the same witnesses that Special Prosecutor Peppers had called and they all identified Sergay as the fourth man in the hotel that night.

Josie called officials from the Medical Examiners Office who testified that DNA extracted from skin cells on Ms.Valentina Natchios neck.

They all testified that the DNA was not from Joshua Hoffman, but from DNA linked to Sergay Moglovich....They had fingerprints and a DNA match for him.

Beverly presented the Champaigne Bottle with saliva from Sergay on it and his DNA and a fingerprint smudge belonging to him...Also with a little Rohypnol still in the bottle.

Peppers went ballistic! "HOW DID YOU LET THAT PIECE OF EVIDENCE SLIP BY?  THAT WAS MAJOR EVIDENCE!!!OH MY GOD!!!" he exclaimed.

Detective Tragg once again looked like he had swallowed a canary.

With this, Olivia made her final argument, that it was Sergay Moglovich who more or less strangled 

Valentina Natchios, whether purposely or accidentally. He was the here to for unknown man in the room.

Judge Telma Bailey had heard enough. She had excused the jury.

"From what I've heard in this past week... I see that there is not enough evidence to warrant a murder charge against ADA Hoffman...For this reason I am dropping Murder charges against ADA  Hoffman!" she said.

"The People concur your honor."said Special Prosecutor Larry Peppers who stared angrilly at

Detective Tragg.

"You...You Boob!  I told you to get on top of this...You haven't heard the last of me." he said.

Detective Tragg had a look of dread .

Olivia and Beverly leaped in the air, high fived each other and yelled-

"WHOOOOOOOOOOOOOOO..WEEEEEEEEEEEE!"

 

Olivia and I kissed passionately...

As did Beverly and Nelson...

"THANK YOU ALL...I AM FOREVER IN YOUR DEBT!" said Assistant District Attorney

Joshua Hoffman.

"And you thought the Judge didn't like you." said Josie, smiling..

"Oh she doesn't..She just liked you guys more."said an exuberant ADA Joshua Hoffman.

"Ohhhh Stopppp!"laughed Bresha.

IV-

DISTRICT ATTORNEY'S OFFICE- THE NEXT DAY-

"Boss you were right...Olivia and Beverly were the best lawyers money could buy...They got me off.

Thank you for getting them."said ADA Josh Hoffman.

"You're Welcome..I knew if anyone could get you off, they could..They're great attorneys...Don't ever tell anybody I said that."laughed Gil Garcetti.. "Oh yeah..The cops picked your boy Sergei Moglovich up in Atlantic City...He's going to be brought back to Philadelphia soon.  Oh yeah , your girl Gretchen Bondi also had her charges dropped...I believe before yours were dropped."said D.A. Gil Garcetti.

"God...Don't mention her...I'm done with her...Thanks for letting me crash with you...I've found an apartment..thank you."said Josh Hoffman.

"Take a few weeks off....You'll be paid....This will all die down and then you come back to work okay?

Get yourself together."said Gil Garcetti.

"Thanks Boss, you're the best." said ADA Josh Hoffman.

In a small Cantina, Lt. Tragg displayed Crabs and Crab Legs on the table...Crabs he had caught from the river during his night duty on the Marine Boat. Crab Fishing had become his hobby.

Today he was getting news he didn't want to hear from Private Investigator, Bert Vandenberg..

"WHAT?  The Judge dropped the charges?" asked Lt. Tragg.

"YES ,Looks Like Olivia and Beverly did their thing again.They found compelling evidence of a fourth guy in that room with them.  They had some wing ding huh? a foursome..." said Bert Vendenberg as he enjoyed cracking crab legs and eating crabs. "Pass me that crab....MMMMMMMMMMM!" he said.

"Yeah they did.."sighed Lt. Tragg dryly..

"Hoffman found an apartment in town...and he was given a couple of weeks off at pay to get himself together."said Bert Vandenberg.

"It's better than he deserves....."snarled Lt. Tragg.

"How much longer you gonna be on this boat?" asked Bert Vandenberg.

"I don't know...They said Indefinitely....They were pretty mad after that prick Hoffman got finished complaining to the bosses about me.." sighed Lt. Tragg.

That Night we all met at Josie's in our community....instead of going to our usual Friday Night spot..The No I.D. Bar.

The Joint was packed as usual...

The House Band was really jamming...

 Drinks were plentiful....

Fried Chicken Baskets

And Shrimp Baskets were at every table...

And trays of Barbecued Chicken was spread out..

"It's always great to come into Josie's , Especially after a big case."said Olivia..she was sitting on my lap and munching on Fried Chicken.

 

"It feels good ...Good to be in our neighborhood.Good to be walking distance."I said.

"Yessssssssss!" said Beverly, who was also sitting on Nelson's lap, sipping a Martini...

Nelson was eating Fried Shrimp and just hugging Beverly.

''We are going to sleep good tonight babe."said Josie.

"Yeah....We don't have to work tomorrow."said Paris.

"Ohhhh I love it! "said Bresha.

"Proud of you guys."said Tony.

Alfreda was in Rockland's lap....

"We don't have to work tomorrow and tonight, We can all walk home."said Alfreda.

"Yeah, that's good... I know they miss us at No I.D. Bar tonight, but this is close to home."said Rockland.

 

"Nice to see you guys in here." said Serendipity. She was sitting on her husband's lap.

"This is such a vibe." said Kevin.

 

''Hey Everybody" said Natika.

"I meant to thank you guys, Olivia, Beverly and company..For what you did for Josh Hoffman."said Deputy D.A. Lester Burke.

Bridget laughed at the thought that the man who prosecuted her was himself prosecuted  and for having a hedonistic party...

 

 "You're enjoying this too much Bridget girl." laughed Yvette.

''Let her have her fun."laughed Yvette's husband Gary.

"Man, I've forgotten how much I love this place." said Keith Jones.

"We used to come here a lot before we lived where we live."said Bee Bee.

''Yeah, we used to have to drive here...Now we can walk here."said Sofia.

"That's always cool..We don't have to worry about driving under the influence or driving period."said Kahlil.

''Well Lt. Tragg never comes in here and I imagine he's not coming in anywhere. He's still on that boat." said Jade.

"It's been a month now... When they said Indefinite...They meant indefinite.."laughed Danny Ho.

"Let's not spoil our afternoon talking about him."said Virginia.

"I agree."said Jetty...

Jazzy was sitting on Dabnis's lap and playfully removing his hands from underneath her skirt..

"Dabnis, stop itttt." she said, laughing..

"Yeah...and I'm Happy Olivia and Beverly got ADA Hoffman off too...Olivia and Beverly 2-DA's Office-0."laughed Chip.

"We were actually doing the D.A.'s Office a favor...D.A. Garcetti personally asked us to defend ADA Hoffman." said Olivia.

"And After we finished laughing...We took on the case."said Beverly.

"That's just what I thought you guys would do...Laugh in their faces....Although I didn't imagine you'd take the case." said Karen.

"I covered the whole six days of trial." said B.L.

"Wow! Garcetti really believed in Hoffman's Innocence."said Natalie..

''Despite his sexcapades."said David.

"I heard Gretchen is already dating someone else.. A Young lawyer, who just passed the bar."said Brooke.

"No Grass grows under your feet..You get all the scoop."laughed her husband, Sean.

"It's knowing who to talk to down at the courthouse."said Zoey.

"Yeah, I guess that's it."laughed Lem.

"For me, it was you, until you passed the bar and got a job!"joked Renee.

"Yeah I was the courthouse connect for a lot of folks until I became a lawyer."said Tyrell

Josie and Paris were kissing passionately...

As were Bresha and Tony 

And Lee and Matthew...

"Ahhhhhhh young love." mused Nina.

"That can be us."said her husband, Carlos..

"When we get home babes." said Nina.

EPILOUGE-

SERGEI MOGLOVITCH was arrested by New Jersey State Troopers and extradited to Philadelphia 

where he stood trial for Manslaughter...He was convicted of Manslaughter and Possession of Controlled substances and sentenced to 10-15 years.  

He is in the same prison with his cousin, Mikal, who is doing 20- life for manslaughter.

ASSISTANT DISTRICT ATTORNEY JOSHUA HOFFMAN  eventually returned to work. For awhile there were a few snickers behind his back, but eventually the story faded away...

He hasn't heard from Gretchen.

Detective James Tragg was assigned to the Marine boat after complaints from Special Prosecutor, Jerry

Peppers;;

He joined his cousin Lt. Arthur Tragg on the same Marine Boat and the same shift...Indefinitely...
