Upgrade

We arrived at 30th Street station before everyone else..

Sean went on a food run for us.

"Ouuuuuuuu thank youuuu!" said Natalie.

"Man, just what the doctor ordered." I said.

Sean got coffee's for us as well as Hash Browns and Egg McMuffins from a local Mcdonald's...

 

We were all very grateful, because we were famished, having to get up so early and come to the train station.....

Karen arrived ...Sean had purchased a coffee, a hash brown and an egg mcmuffin for her.

"OH God Bless you Sean! Just what I needed."said Karen...

"Hi Everybody" said Lee...

"Hey Guys...." said Matthew,,,

We felt bad we hadn't gotten any coffee for them or food...but Matthew ran and grabbed a coffee..

He grabbed two coffees and two hashbrowns for the two of them....

John Ivey Jr. was the last to arrive..

He had a coffee...No food though...He was surprised to see Lee with her new boyfriend Matt, sitting together.. He hadn't known Matt was going..He knew nothing about him...

Karen broke the ice..

"John, this is Matthew Akes...He's an Attorney from the International Consulate here in Philadelphia.

He's not taking part in our case...He's just keeping our Para-legal, Soon to be Dynamic Attorney Lee Phillips company." she said... "Matt this is John Ivey Jr.  He brought the case to us." said Karen...

"Pleased to meet you.." said Matt...

"Likewise.." said John..He was very uncomfortable..

John sat with Karen, who he also found very attractive..

.He knew who her husband was...Attorney and TV Talk show host and Podcaster, B.L. Benz... 

 He was a very lucky man to have a fox like Karen as a wife ,he thought...

He attempted to start a conversation...

"So Uh, We all Know I went to Middleton School Of Law...Where did you guys do your Law School?" He asked.

"University Of Pennsylvania School of Law." said Karen...

"Temple University's Beasley School Of Law." I said.

"Georgetown School Of Law." said Natalie.

"I graduated from Middleton, like you did."said Brooke.

"Ohhhhhhhhhh!" said John with a smile.

"Georgetown School Of Law...Same class as Natalie...but we didn't know each other surprisingly."said Sean.

"Yeah ,Big Schools are like that." said John..

"I graduated from Yale School of Law." said Matthew....

John felt intimidated for the first time....Lee had really gotten an upgrade...

"Ohhhhhhh!" he said.

A Yale trained Attorney.....WOW!

Lee smiled...She knew he was fishing, trying to see who her boyfriend was..His pedigree...

II-

We arrived in the town that housed The State Correctional Institution at Greene, Pa.

The first thing we needed to do was find a diner...

We found the diner we ate at the last time we were here...

Despite being Black...Natalie turned heads when she walked in with me..She was still a beautiful woman...

I was proud  to be her husband,,,

Brooke walked in...She turned heads too, but for two different reasons. She like Natalie was a very beautiful woman ,who turned heads also...

She also had a Black husband....and in this town of mostly white people, that was a head turner....

Lee Phillips, a beautiful Asian Woman walked in....

Her Black Boyfriend, Matthew Akes had heads turning also....

Even though they weren't a couple....Karen walking in with John Ivey Jr. was more to the people's liking..

No one said anything to us... but the stares did kind of un nerve us..

We had some breakfast....Good Comfort food like we had at Sam Mother's Diner at home...

Our first road trip in awhile..

We found an inexpensive , (ie cheap)motel not far from the diner we ate at...

Our rooms looked a lot better than the outside of this motel...

We all met in Karen's room....She had a room to herself.. Natalie and I were next door to her...

Brooke and Sean were next door to us....

Lee and Matthew were at the end of the hall...

And John Ivey Jr.....The Only other person to have a room to himself was directly across from them...

We ordered a Large Pizza...

and some beers......We spent the rest of the afternoon,laughing talking , eating Pizza and drinking beers..

We finally all said good night and retired to our rooms...

"MMMMMMMMMMMMMMMMM, so nice to be finally alone...Those beers gave me a buzz and you know how I get when I drink like that." said Natalie..

We walked past the cell door of Former Judge James Wilson....Convicted of three murders and sentenced to death....He saw Sean Marks , who he blamed for his imprisonment...

"MISTER MARKS!" he said.

"Never thought I'd see you again." said Sean.

"You'd better pray that I never get out of here...I'm going to find you and kill you...and steal your pretty wife!" said Former Judge Wilson...

"Dream On!!! But I'll promise you something....I'm going to come to your execution...I'm not going to miss that you sadistic, racist son of a bitch!" said Sean uncharactoristically angry..

"Come on man, forget about him....He's nobody." I said, pulling Sean away as we walked toward the cell of our client.

The meeting room was small , but well lighted and somewhat comfortable..

The women, Karen and Natalie, Brooke and Lee all sat 

while we men, Myself, Sean, Matthew and John stood ...

Our client was brought into the room...He was clean shaven and clean cut, although a bit gaunt....

Considering his circumstances, he was in surprisingly good spirits....

"So you guys are my new lawyers huh? Good!" he said upon meeting us.

"Hello, I am Karen Page, Supervisor of Philadelphia's Wrongful Conviction, Conviction Integrity Unit and we are going to be handling your appeal....These are the attorneys that will be handling it."said Karen...

"I'm Attorney Natalie Charles." said Natalie.

"I'm Attorney David Charles. Natalie is my wife." I said.

"I'm Attorney Brooke Marks." said Brooke.

"I am U.S. Attorney Sean Marks, A Federal Public Defender...I'll be working with them on your case... I'm Brooke's husband." said Sean.

"I'm Lee Phillips, I'm a Para-legal.....I'll be graduating from law school in a few weeks." said Lee.

"And I'm Attorney John Ivey Jr.~" said John.

"John Ivey Jr. Eh?  Your Father was my original attorney...Oh wow!   You were in law school at the time of my trial..He always had such high hopes for you....He was very proud of you... And you sir, are you on my defense team also? he asked Matthew..

"I am an attorney, but I'm not involved in your case....I'm just here as a guest of Ms. Phillips, the para-legal...She's my girlfriend.." said Matthew..

"You have good tastes...All of you married guys have good tastes..."laughed Jack Stanton...

"You know what's funny...I'm two cells down from the jerk who sent me here...Judge or I should say former Judge James Wilson....Aint that a kick? Who would have thought he'd wind up on Death Row himself? For Three Murders at that? Hahahahahahahahahahahahahaha!"laughed Jack Stanton... "He gets death threats every single day....Imagine that...being on Death Row and getting death threats."laughed Jack Stanton.

"Yeah, Imagine that!"laughed Sean.

"I'm not going to lie to you....I was a thief, A master safe cracker...What they call a Box man and a

heist guy......I had just got out of prison six months before and I got a job shampooing rugs on the main line..

I was shampooing old lady Monohans's house, when I saw her safe in her bedroom... I cased the joint...for about a week...I knew her moves...On this certain night....She went out... I went to my fences place of business...a pawn shop and bought my tools....Tools I'd need to break in her house and to beat the safe.

I broke in...I went up to her bedroom and I beat the safe...Only there was no jewelry...just papers...The deed to the house...and what not....I left....and I never went back....I returned the tools to my fence and I went and got drunk....The way I figure...Somebody else must have followed me there and broke in after I left and surprised old lady Monohan and killed her...but it wasn't me....I swear, that's the truth." said Jack Stanton.

"Your fingerprints and your DNA was found in the house....That's pretty sloppy." I said.

"Did you read the entire transcript?  There was another set of fingerprints found in that house too..Not mine, Not Mrs. Monohans that the police couldn't identify....That's more than likely your killer...but the police never looked into it any deeper..."said Jack Stanton..

"Who was the arresting officer? Let me guess....."said Natalie.

"Lieutenant Arthur Tragg!" said Jack Stanton...

"WHY AM I NOT THE LEAST BIT SURPRISED?" said Brooke, exasperated..

"And to make matters worse that Judge, James Wilson had a thing for the female prosecutor....He kneecapped  poor Attorney John Ivey...Dismissed every motion....When he dared argue back,he threatened to hold him in contempt....He just made it impossible for the defense...in both of my trials...If I get a new trial...I'll be so glad that at least HE won't be the Judge..."said Jack Stanton...

"No he won't....Soon he'll be Judged by a higher court.." said Karen...

"And thank God for that!" said Sean...

We all laughed.

"We are going to State Appellate court tomorrow to argue your appeal. This ought to be good education for you Lee."said John Ivey Jr.

"I expect it will be." said Lee.

THAT NIGHT-

We all met in Karen's Room again...All of us except John...He chose to crash early in his room!

"In order to win an appeal...You have to have new evidence and proof of prosecutorial misconduct. There is no prosecutorial misconduct...but the fact that there was another set of prints and DNA that the police never identified is more than enough to cause reasonable doubt....That's what we go with."said Karen.

"Let's hope our oral arguments pan out." I said.

"Keith Jones told me of a case they had in which they argued prosecutorial misconduct and had a little bit of new evidence and three State Appellate courts wouldn't hear it...He took it to the State Supreme Court...they wouldn't hear it and he went to the Governor...Goose eggs.... Their client got executed before the State changed the law, a month later."said Natalie.

"Didn't do his client any good." said Sean.

"We've got Thirty Days..." said Brooke.

"I'll be a Lawyer by then."gushed Lee....

"Yes you will." gushed Matthew, hugging her....

As we drank beers and munched on cheese burgers....
