Like A Fish To Water

 We were finished our day in court....

"We got a continuance...We were lucky huh?" said Beverly..

"After three hung juries...We were lucky to get anything breaking our way." said Olivia, who looked exhausted.

"Liv you seem Pre-Occupied. You don't seem as laser focused as you usually are." I said.

"Something is on my mind Donnie Ray...I'll tell you about it later." said Olivia.

"Heyyyy look who it is." said Nelson..

"Heyyyy Girlie...Lookin good." said Josie.

"Hiiii Lee." said Bresha, hugging her...

"Heyyyyyyyyyyy Guys!" said Lee..

"Damnnnnnnnnnn baby, you look good!"said Nelson, smiling..

"Being a lawyer looks good on you...You had a case today too huh?"

"Yeah ,something simple....What are you guys getting ready to do?" asked Lee.

''Right now, we'd like something to eat...We've been in court all day...Why don't you join us at Sam Mother's ?" I asked.

"Come Join Us  at Sam Mother's Baby...Your meal is on me." said Olivia.

"Sounds Like a plan to me.."laughed Lee...

We walked over to Sam Mother's Diner...

where we all had a hearty breakfast.....

Detective William Swift walked in with a smirk on his face and walked over to our table.. He seemed to be addressing Lee.

''Well Hello Ms. Phillips..Fancy meeting you here."he said, looking her up and down.

"Hello William." said Lee.

"You know Detective Swift Lee?" asked Beverly..

"It's Not Detective Swift anymore...I turned in my shield last week..It's Assistant District Attorney William Swift now." he said.

"WHATTTTTTTTTTT?  You Passed the bar?" asked Olivia..  He had graduated from law school many years ago...He had failed the bar five times....and had settled for being a policeman and eventually a Detective...

"Yes, a few months ago, I began studying for the bar again....and this time...I passed with flying colors.. I met Ms. Phillips the day she was taking the bar.. We got sworn in together, I mean the same day..."he said..

"Well congratulations are in order.."said Nelson, smiling and shaking his hand..

"Congratulations." said Josie.

"I guess the sixth time is the charm" Bresha whispered to Beverly..

Beverly giggled....

None of them particularly liked Detective Swift and the feeling was mutual.  

"You know I actually graduated from law school two years before you did Olivia." he said.

He liked Olivia....He liked the way she looked..He thought she was sexy...

"Really?" said Olivia with mock surprise...(She knew) ''And all this time you were a cop? Wowww!~" said Olivia.

"Yeah I know...but I never gave up my dream of being a lawyer... Garcetti hired me last week.." said William Swift.

''Well Congratulations to you." I said.

"Next Time you see me , you will be facing me in court..." he said happily...

"Well, we look forward to that day....Congratulations again William." said Olivia.

"I was nervous enough the day I took the bar..and I ran into him...he talked my ears off about how he took the bar when I was 13 years old and failed it and took it four more times over the years while going from Beat Cop to Homicide Detective....I was thinking, I hope I don't fail it and have to take it multiple times.  He had me spooked. I wanted him to shut up!" said Lee..

"Nobody in our group failed the bar...We all passed it on the first try , just like you did...I mean all of us, Ms. Yvette and her group, Jazzy, Kayla, Zoey, Lem, Renee, Dabnis, Ray, my husband, Tony, Tyrell, Jessica, Chip,Natalie, Brooke, David, Sean..everybody...we all passed it on the first try...He's just a blockhead...That's why it took him so long to pass." said Josie.

Bresha laughed hard!

"WOW!! SIX TIMES!" she said, shaking her head.

"I knew you'd pass it on your first try Lee....All the good training you got from all of us. Everything was fresh in your mind."said Olivia.

"You're right...I sat as far from him as possible and everything just came flowing into my mind,like it was second nature. He actually tried to flirt with me...Asked me if I was seeing anybody....I quickly told him I was in a serious relationship and that my boyfriend was waiting outside for me.."said Lee.

"Ouuuuuuuuu go head Hot girl...driving men wild."laughed Beverly,playfully  slapping Lee on the back.

"I'm happy just to drive my boyfriend wild." said Lee...which she did..Matthew couldn't keep his hands off of her.

Sam Mother was happy to see all of us once again.

II-

That Afternoon-

"Hi Olivia ." said Brooke.

"Hiiii Brooke...Is Sean home?  Really I need to see you both." said Olivia.

"Come in...Come In..." said Brooke.

Olivia looked around..

"You two have a beautiful home." said Olivia.

"THANK YOUUU!" said Brooke.

"Hi Olivia. to what do we owe this visit?" asked Sean..

Olivia showed several photos of her through the years in Swimming competitions

"This was me when I was a bit younger in State Swimming competitions.." she said humbly.

"You won't believe this...but I'd heard of you...Years before I ever met you...And I didn't put two and two together that you and the swimming champ I admired was the same person until you became my defense attorney...I used to swim too...I was never as good as you...but you were like my hero back then..when I was in High School." said Brooke.

Sean was salivating over Olivia's sexy body...How tight it was then and how she was still just as sexy , just as fit now... "No wonder Donnie Ray quit his whole life in New Orleans and followed her to Philadelphia....my god...She's a sexy woman." he thought.

"I'm not here to brag about my accomplishments...Before I was even born, before my parents even met..I had an Uncle.. My Father's youngest brother named Elroy Bennett...Who was a champion swimmer.  My Father said he took to the pool "Like a fish to water."  He was the youngest of four boys.

My Father being the oldest, My cousin Kayla's Father,Leroi Bennett being the next oldest and my crazy uncle, whom you've all met, 

Robert,My Uncle Robbie, being the next to the youngest and the only surviving sibling of my Father and his brothers. He is the reason I'm here...

He came to visit us a week ago and he was troubled. He said he had a dream about my Uncle Elroy, who I've never met... a dream that was very vivid and a dream that I've come to find out my Father and my Uncle Leroi always believed... That my Uncle Elroy was murdered."said Olivia.

"MURDERED!" said Sean...

"OH MY GOD!" said Brooke.

"In 1971..When he would have been 12...My Uncle Elroy won the Philadelphia regional Swim Competition...Which was a big deal then because Black people weren't even allowed to compete until around 1955....and he won!!  It was big news...He was in all of the Newspapers...Not just the Tribune, but the Bulletin and the Inquirer... He even made the local news..The child who made 2nd place was a young man from New York City...who's family had just moved to Philadelphia.. He was 13 and he took it very hard... His name was James Wilson."said Olivia.

"Wait!! WHAT???   THAT JAMES WILSON???  JUDGE JAMES WILSON??" asked Brooke, laughing..

"OHHHHHHHH!!! OHHHHHH MY GOD!!!"laughed Sean...and now he knew why Olivia was here.

Olivia showed a photo of him being consoled by his parents as her 12 year old Uncle was being awarded his trophy...

"Yeah that's him!"laughed Sean....

"They competed again for the P.I.A.A. Regional semi-finals and my uncle won again....and this time James Smith came in third...Another young man came in second. Those two were going to the State Championships....and if you look at these old photos...He was again inconsolable." said Olivia.

"Two days before the State Championships...My Uncle was found floating in the pool...Dead.

It was a shock to the entire community!  They said he had hit his head and fallen into the pool..It was ruled an accident, then later ruled "Suspicious." He was fully clothed.

A Day later, the second runner up mysteriously dropped out of the competition...." said Olivia.

"Let me guess... James Wilson went on to the State Championships." said Sean.

"Yes...He won." said Olivia. "State Champion of 1971.  My Father always said, he didn't deserve it and that if Elroy were alive...That Trophy would have been his." said Olivia.

"You think....You think...That even at this early age.. This guy could have committed murder?" asked Sean, incredulous.

"I think, whatever is screwed loose in that Judges head, began a long time before he entered Harvard, a long time before he passed the bar and a long time before he put on his robe and sat in Judgement of others." said Olivia.

III-

Olivia came home that afternoon after visiting Brooke and Sean..

"Hi Husband.." she said.

"You're back.....I take it you ran your theory by Sean about Judge James Wilson killing your Uncle all those years ago huh?" I said.

"I did." said Olivia solemly...

"Liv that was 54 years ago... some years before either you or I were born..Impossible to prove.

Any witnesses are probably dead or close to it..and James Wilson is on Death Row, for three murders we know he committed, he has absolutely no reason to cop to that...He's not going to avoid one less needle prick."I said.

"I know." she whispered.

She planted a soft, wet kiss on my lips..

"Ummmmmmmmmm let's go to bed." moaned Olivia..

"I can't think of a better place for us to be." I said.

We retreated to the bedroom...

TWO DAYS LATER-

We were all in Court for the verdict....This was the fourth trial...We had had three hung juries... 6-6 in the first, 7-5 in the second and 7-5 in the third... going our way! This jury had now come to a decision.

"Has the Jury come to a decision?" said Judge King.

"We have your honor." said the Jury Foreman.

The Jury Foreman passed the envelope to the bailiff.

We were up against a friend of ours Abigail Wilson-Walker.. She was tough and smart and prepared and we didn't take any of this personal...It was business, the business of being a lawyer.

 We stood with our client, Cecil Walker, A Black Handy man  accused of murdering his employer.Like us, he was exhausted... This was a pro bono case we took from the Public Defenders Office...We took about three a year, We did this one as a favor to Nelson.

 

Cecil had been in jail for a year....He was hopeful he would at last be a free man....

The Judge read the decision...Without giving away anything in his facial features...He passed the decision to the Bailiff..

"Read it!" he said Softly...

"REPRESENTING THE COMMONWEALTH OF PENNSYLVANIA..WE THE JURY IN THE MATTER OF COMMONWEALTH OF PENNSYLVANIA VS. CECIL WALKER ON THE CHARGE OF SECOND DEGREE MURDER, WE FIND THE DEFENDENT, NOT GUILTY!" he said.

"I want to thank the jury for their attention to the details of this case....You are hereby dismissed...You can exit through the center doors...Your checks will be in the mail.. Mr. Walker, you are free to go." he said.

"THANK YOU JESUS!! THANK YOU!!" said Cecil Walker..shaking Nelson's hand.. He was a member of Nelson's mother's church, which was how we found out about the case.

"I told you it would be alright...I told you we'd be with you until the wheels fell off ." said Nelson...but he wondered if another hung jury or worse a conviction would have kept the group going strong.

Olivia and Beverly leaped up, high fived each other....

"WHOOOOOOOOOOOOOOOOOOOOOOOOO WEEEEEEEEEEEEEE!" they shouted in unison.

"You did a hell of an investigation Donnie Ray...We couldn't have done it without you."said Josie.

"I confess , I thought he was guilty at first, but the more I looked into the case, the mis-steps the detectives made and what not...the more I realized how circumstantial the evidence was against him and how someone else may have done this." I said.

"This was the best of the four juries that we got...I'm really exhausted....We need to have some fun now."said Bresha, who like all of us was relieved the trial was over.

"Right now a girl needs a cold one." said an exhausted and relieved Assistant District Attorney

Abigail Wilson-Walker.

"Girrrrrrrrrrrrrrl , you aint never lied...First drink is on me at Josie's." said Olivia.

"I'll buy you one too!"laughed Abby...  "I don't want to see you guys no time soon." she said.

"Likewise." said Beverly, smiling.

IV-

A beautiful and warm weeknight...We were all in Josie's , our neighborhood spot, celebrating our victory in court..

As usual, the place was packed.

"Thank you for the beer Olivia." said Abby..

"Oh you're welcome girl...whew...You put on a show during this trial..You really tested us." said Olivia.

"You guys tested me!" said Abby, smiling.

Showing one opponent's respect for an equally worthy opponent....

There was plenty to drink and a live band playing tonight...

Our friends in law enforcement, Lt. Sissy Van Buren and her detectives from the Criminal Investigation Divison were here tonight, sitting together at a table.

"That Band is cooking tonight."said Sissy.

"It is.. I'm surprised Donnie Ray isn't up there playing."said her husband, Eddie C.

"He's relaxing...They just finished a case today...Just like we just locked up a Crime Boss and a Serial Killer."said Detective Carlotta Rodriguez-Wallace.

"Yeah...and they had the same idea we had..Come out and relax at Josie's." said her husband, Deputy District Attorney Keith Wallace.

Sirena was sitting on her husband Tyriq's lap sipping her drink...

"You want another drink Ang?" asked Jimmy.

"No, I'm good, but thank you for asking." she said smiling. She was two years older than her husband, but he had always been very protective of her..She appreciated that.

Hop and Sharon were staring in each others eyes dreamily like two teenagers..Tonight was truly magical.

Gus, the Owner and head bartender was snapping his fingers to the beat of the music..

"Ha Ha..Do it Gus."laughed Duke.

Hazel smiled. She was relieved to be off tonight and out with her man.

While we sat with our group at three large tables on the other side of the stage where the band was playing.

"Nice night out tonight." said Olivia.

 

"Yeah, real nice...I'm glad we all came out..." I said.

"Josie's is so warm,.so cozy...Our safe place." said Beverly..

"Our guaranteed safe place." said Nelson.

"I think everybody in here feels the same way." said Josie.

"That band is really cooking tonight." said Paris.

"It is and the drinks are cold and cheap."said Bresha,

"Can't beat that." laughed Tony.

Alfreda leaned back, kicked her flats off and rested in her husband's lap...

Rockland held her gently and smiled. 

 "Ouuu Gary, tonight is sooo nice...."said Yvette , resting her head into his arms..

"Yeah, the weather is warm..The musoic is good and the beer is cold..Can't ask for nothin better." said Gary.

"This is a good night for making love."whispered Keith in his wife's ear.

"Every night is a good night for making love to you..." laughed Bee Bee...

"Ummmmmmmm papi, what are you thinking?" asked Sofia... "Never mind...I already know." she giggled.

"Hmmmmmmmmmmm I wonder about that."laughed Kahlil.

"All of your cop buddies are here tonight."said Jade to Danny...

"Yeah, I like it when we all hang out together..It's why I like this place." said Danny Ho.

"I like it too..It's walking distance from most of our homes and it's our safe place."said Virginia.

"I used to drive over here from where I was living then, just to hear the good music and enjoy some good barbecue." said Jetty. 

"So did Dabnis and I...We never dreamed we'd live in the neighborhood." said Jazzy.
 

"They were breaking ground for the homes we now live in."said Dabnis.

''We bought these homes just in the nick of time."said Kayla.

"Yeah..we are right near everything...Three Shopping Centers,A Movie house, two pother clubs...lots of eateries...You can't beat this neighborhood."said Ray.

"We were looking for a place like this..With real people and lots of places to shop and for entertainment."said Jessica.

"Yeah we were."said her husband, Chip.

"With my tywo dearest friends living here...Olivia and Yvette, It was never a question in my mind, where I wanted to live..."said Karen.

''We just couldn't get rid of her."laughed Yvette, huigging her friend.

"Since Law School, she's been following us around."laughed Olivia, also hugging her.

"You three are funny."laughed Karen's husband, B.L.

"Nice night out tonight. Huh?" said Natalie to her husband, David.

"It is..Nice and warm, balmy, a good night for making love."said David.

''Every Night is a good night for making love for you."laughed Natalie,, who was sitting in his lap.

"Sean, I want to help Olivia...And I think I know how." said Brooke.

"Tell me." he said..

Brooke whispered in his  ear.

"Olivia said after she finishes up some business she's going to find a nice place for us to rest and relax a few days that is not Nelson's beach houses..." said Zoey.

"What Business has she got to finish? They won their case today." said Lemn.

"You know them...They're always tangled up into something."laughed Renee Cantrell.

"They get the best cases."said her husband, Tyrell.

"They do....That's how they trained my new employee, who has won her first 13 cases."laughed Nina Rios, once an ADA, now an Attorney for the Women's Law Center.

"Can't get any better training than that."laughed Carlos.

"Here Here."laughed Lee, raising a glass.

Matthew hugged her and whispered in her ear..."Babe you look so good tonight." he said.

"You're horny aren't you?   It's okay if you are..We are going home soon." said Lee, smiling sweetly at Matthew..

She loved him deeply and she loved all of her new friends, Mostly attorneys ,who lived around her and worked near her too!

The night moved on.....

Olivia sat ,listening to the music.

Brooke who was the same age as her niece, Beverly sat down next to her.

"Olivia...I know how it feels to have something nagging at you like that...You need to know...

You know of course that he has no reason to confess..He faces execution for three murders already...but I'm hoping he might want to just clear his conscience...If he has one.  I think I can get him to confess." said Brooke.

"You? HOW?" asked Olivia.

"He has a thing for me. He always has...He writes me from Death Row, begging me for photos in a bathing suit and or in my underwear...I have thrown those letters away for the most part..but I think I could visit him and break him down...I want you to go with me....I can get you the proof you need ,that he murdered your Uncle all those years ago." said Brooke.

And not too far away in Montgomery County,

At the State Correctional Institution at Phoenix. , Which houses the State's New Death Row..

James Wilson has been moved. He's closer to his former Philadelphia Home.

On Death Row ,in his cell..

Former Judge, James Wilson, now a convicted murderer dreams of Brooke..
