VENTURES: Straightening Things Out

It was Trial Day....

Our friend Attorney Elaine Young , who was also trying a case here brought steaming hot tumblers of coffees for everyone..

"Thank you so much for the coffees Elaine.." said Olivia.

"Yes this is always what the doctor ordered before a big trial." I said.

"Thank you Elaine....Your trial is down the hallway isn't it?" asked Beverly.

"Yes it's two courtroom's down." said Elaine...

"Wow...you'll probably be dome with yours before we are done with this one." said Nelson.

"But I hope we are all equally successful.." said Josie

"I hope so too...I've got at best a two day bond case." said Elaine.

"Oh wow...I like those kind of cases...I've had a few myself..Usually not too complicated." said Bresha.

"Our client, Dr. Hector Sosa sat quietly and calmly...He smiled at Elaine and she quietly smiled at him..

She sat down next to him....It was as if the heat from her body aroused and calmed him all at once.

Karla arrived just in time to get the last coffee...

"Thank You." she said. She looked at or client..

"You ready Hector" she said with a smile.

"Well here we go...Ready Hector?" asked Karla.

"As ready as I'll ever be." said Hector.

COURTROOM A- 9:00 AM

"GOOD MORNING!! GOOD MORNING ATTORNEYS AND PERSPECTIVE JURORS!I am Judge Kelly Mercer..I see some familliar faces today.Welcome to my courtroom....Due to courtroom crowding of cases , we are going to bypass a preliminary hearing...We know that a crime, a henious crime has been committed so we are going to go straight to trial.. I expect, some of you are tired of hearing this...but it is what it is..We are trying to wind down our case load.. We will have Jury selection today.. Trial could begin tomorrow morning if we seat a jury today.." said Judge Mercer... "We will start today with introductions.." she said.

"Representing the Commonwealth of Pennsylvania, Assistant District Attorney Lance Roderick your honor." said Lance Roderick.

She didn't know him., but she found him very attractive.

"Karla Richardson, Lead Attorney for the Defense your honor." said Karla.

"Olivia Bennett-Alexander, Co- Lead Attorney for the Defense Your honor." said Olivia.

"Mrs. Beverly West-East-, Attorney for the defense your honor." said Beverly.

"Nelson East, Attorney for the defense."said Nelson.

"Mrs. Josephine Boyd, Attorney for the defense." said Josie.

"Mrs. Bresha Billips, Attorney for the Defense.your honor." said Bresha.

Our client, Dr. Hector Sosa sat next to me quietly....

He was surprisingly as cool as a cucumber.

I sat with my legs crossed with a stoic look on my face.

He looked at Elaine Young sitting in the visitor's section and smiled. Her case wasn't to start for another two hours.

She smiled back!

"I beleive I know you guys....You've tried a case in my courtroom before...Welcome back!" she laughed.

She was pleasent woman, with a beautiful demeanor.. I wondered as did we all what she possibly saw in Lt. Tragg and marveled how she changed him...made him less unhinged...almost likable! It was like Beverly said.."The Power of the panties...or maybe this was something more.

"We'll begin with Jury selection" said Judge Mercer...

ADA Lance Roderick knew a thing or two about Trial Science and Jury selection.....He had some well thought out questions prepared...

But Nelson had the slight advantage...Our technology and my brilliant run down of each of the jurors, the way they voted in elections, their jobs, their education level, et al...Gave us the slight edge... We knew it all going in...

Bresha and Josie, his little understudies , Protoge's if you will, both were helping him today...They sat behind their laptops and whispered certain things they had talked about into his ear.. He smiled.

"They're good."said Hector.

''He's our ace when it comes to jury selection. And the girls are getting to be just as good" I said, Speaking of Josie and Bresha.

Once again..Nelson got a 10-2 split...Not bad, Not Bad at all...

ADA Lance Roderick looked perplexed... Olivia's young associates were more prepared than their years portrayed. He thought, they were like seasoned attorneys twice their age...

"OUTSTANDING!!! We have a jury.."said Judge Mercer...Trial will begin promptly tomorrow morning at 9:00 AM, Jurors, Attorneys Be on time and Be ready for trial." said Judge Kelly Ann Mercer.."You are dismissed." she said, striking her gavel.

Court was dismissed....

Lt. Tragg was standing outside the courtroom...

"Hello Your Honor...I am Lt. Arthur Tragg the third....I am presently the investigating officer on this case..Heh heh heh." he laughed..

"Yes, I know who you are Lieutenant. I know you intimately." said the Judge..

ADA Lance Roderick, is a good Prosecutor , I have no doubt about that..but he was handed a case with a suspect motive and very little proof that our client perpetrated this crime... After a few days , even he realized it...

His closing arguments were lackluster and uninspired ...

I watched him as he sat down,looking dejected..

Karla and Olivia ran rings around him and totally eviscerated all of his witnesses...

To his chagrin..Beverly, Josie and Bresha provided relief for Karla and Olivia...

I'll give him credit...ADA Lance Roderick put up a good fight, a better fight than he had put up the last time we clashed years ago...He had several objections....but we backed up what we were doing with current laws, laws from simular cases and predicates..

Predicates Judge Kelly Ann had to respect. She was impressed with how disciplined and well prepared Olivia had her young attorneys were...

While Lance Roderick was annoyed and perturbed.... He wanted to win this case very badly..... but now it was our turn...

Karla ,Olivia,Beverly and Nelson painted a narrative over the next few days of a man who desperately loved his wife and was afraid he was losing her... After a tender night of lovemaking, to his shock, this woman left their marital bed, got a shower , got dressed and took a phone call, a phone call from a man she believed had gotten her pregnant, who was telling her that they were through... He listened as they argued and she threatened to tell his current girlfriend, who she understood was also pregnant, all about him and her..

She was at those lofts, not looking fro Gilberto Salizar, but looking for his girlfriend ,who had no idea she was in the picture.

Gilberto ,they argued...couldn't allow that ,so he laid in wait and killed her....

ADA Lance Roderick argued that this was all hearsay and that there wasn't a bit of proof......

Josie called Gilberto Salizar to the stand...

Gilberto was scared...

His very pregnant girlfriend, Elaine Guadolupe was in the visitor's section crying her eyes out.. She was 7 month's pregnant with his child and furious....She here to for did not know about Carmelita..

Of course He denied everything, Denied even knowing Carmelita....He had "Washed" her phone, deleted all of her phone calls and texts...He thought he was in the clear. Only, he wasn't.

Josie held the phone up....It was Carmelita's phone..

"I have a phone just like this..Sure when the police found her phone there was no record of any calls... but the police and our investigator know that with a simple court order the phone company can bring up her entire PHONE CALL HISTORY!" said Josie.

"I was at the movies that night...I have the stub here with me....People saw me and if you check I'm on the video from the theatre cameras.." he said, smirking..

"We did check.....You were at the movies....but the movie let out at 11:49 pm...... You called Carmelita a little after 12:00 am and Carmelita was shot to death around 12:45 am.....You can't account for those hours can you?"said Bresha.

"Funny thing about these phones....They have something called GPS....it lets people know where you are at every minute of the day....The GPS on your phone shows you in the vicinity of the murder at exactly the time of the murder....The reason why you aren't caught on camera fleeing is because you simply went inside and went to your girlfriend's apartment." said Nelson.

"I was nowhere near those lofts that night...I don't care what your GPS says.."said Gilberto..

"Oh I think you were and I can prove it." said Olivia... but before she could call her next witness...a resident who knew him and saw him...His girlfriend, Elaine, yelled out...

"Gilberto you lie...You did come to my loft that night...it was late...You did come in!!" screamed Elaine, in tears....

"No more questions for this defendent your honor...The defense rests." said Karla.

Our point had been made.

"I told you to talk to him, get him in the box...what happened?" said ADA Roderick to Lt. Tragg.

"We searched for him...We couldn't find him." retorted Lt. Tragg.

"But Olivia's husband found him!! What does that say about you?" snarled ADA Roderick angrily..

IV-

TWO DAYS LATER-

"I thought the jury would have come back with a verdict quicker than this."said Karla.

"Is that good or bad.?" asked Hector. The prospect of life in prison didn't look or feel attractive to him at all.

"It could be good or bad.. Juries are funny...But I must admit...I expected them to come back quicker than this myself."said Olivia.

"I did too...I thought we laid our case out very well." I said.

"We did and we had a good jury...Very thoughtful...Very Intelligent."said Beverly.

"They asked a lot of questions...I think that's a good sign...."said Nelson..

"I'm crossing my fingers."said Josie.

"I'm with Nelson..I think we had a good jury." said Bresha.

ADA Roderick and Lt. Tragg stood along with us as Judge Kelly Ann took the bench..

"Has the Jury come to a decision?" asked Judge Mercer.

''We have your honor" said the Jury Forman.. He passed the verdict to the Bailiff who passed it to Judge

Kelly Ann.

She read it and smiled.She looked relieved....

"Read it" she said.

The Bailiff read it..

"COMMONWEALTH OF PENNSYLVANIA IN THE MATTER OF HECTOR SOSA ON THE CHARGE OF MANSLAUGHTER, WE FIND THE DEFENDENT, NOT GUILTY!!"

"COMMONWEALTH OF PENNSYLVANIA IN THE MATTER OF HECTOR SOSAA ON THE CHARGE OF SECOND DEGREE MURDER, WE FIND THE DEFENDENT , NOT GUILTY!!

"THE MOST SERIOUS CHARGE, COMMONWEALTH OF PENNSYLVANIA IN THE MATTER OF HECTOR SOSA ON THE CHARGE OF FIRST DEGREE MURDER, WE FIND THE DEFENDENT, NOT GUILTY!!

Beverly and Olivia leaped into the air, high fived and yelled "WHOOOOOOOOWEEEEEEEEEE!"loudly.

Hector hugged Karla, with tears flowing from his eyes..

"Thank you my dear friend, thank you.." he said.

"You're welcome..." she said.

"And thank all of you guys too!" said Hector to us..

"You're so welcome."said Olivia.

"All in a days work." I said.

"You're welcome."said Beverly...

"You're really a free man now...and you can come out with us tomorrow night...COUPLES NIGHT!" said Nelson, looking at him slyly..

"It's okay Hector...We know about you and Elaine." said Josie.

"Yeah..we figured it out with that kiss she laid on you...That was a bedroom kiss."said Bresha.

"You can't keep matters of romance away from these women man." laughed Nelson..

Elaine walked up to Hector...She smiled.. She knew we all knew..She hugged Hector...

Hector smiled....

ADA Lance Roderick had dueled with us and lost again...He hung his head and walked out of the courthouse..

While in the Judges Chambers- Judge Kelly Ann and Lt. Tragg were making up for lost time...

"I'm glad that trial is over...Sorry it didn't go your way."said Judge Kelly Ann.

"That's okay..the uh law of averages says that Olivia and Beverly and company are gonna lose and lose big one day..." said Lt. Tragg...

"Ohhhhhhhhhhhhhhhhhh Arthur...OUUUUUUUUU!" she cooed..as they began kissing.

Gilberto Salizar was convicted of Manslaughter and sentenced to 15-30 years in State Prison. He deserved more time.

His former girlfriend, Elaine had his baby, a boy, which she named Jose...She moved to Puerto Rico and refuses to have anything to do with him...
