TRIAL DAY- COURTHOUSE WAITING AREA-

"Coffees Anybody?" said Bee Bee.

"Coffee!!" said Sofia.

They passed out hot steaming tumblers of coffee to everyone from the coffee shop down the street from the courthouse.

"Thank you ladies...This Coffee is good but it's got competition from that coffee shop in Midtown."laughed Yvette.

"Thanks Bee Bee, Sofia.You're right about the Coffee Shop in Midtown giving it competition." said Ms. Jade.

"It's got competition from that place called Mocha Joe's across the street from where you guys work." said our client, Brenda Cherry.

"Look who it is ,Susan Hyland..." I said.

"She lawyered up! You called it Ms. Yvette."said Kahlil.

"And look who her lawyer is H.Stanley Stanlison, a former Judge himself, now Defense Attorney.Funny how we are in the same business, but I don't want to allign myself with him...He's sleazy and his clients are all sleazy." said Yvette with a bit of unusual rancor.

Susan Hyland didn't look at us at all..She walked past us..

"Mrs. Jones-Lockwood...Good Morning." said H.Stanley Stanlison as they walked into the courtroom.

Assistant District Attorney William Swift walked into the courtroom with Lt. Tragg.

They both nodded in acknowledgement of us...

''Well, let the games begin." said Brenda..

Olivia, Donnie Ray, her niece, Beverly and her husband, Nelson, Josie and Bresha came....

"Hi Vettie, Guys...We came to show our support." said Olivia.

''Awwwwww thank you Liv" said Yvette, hugging her best friend.

"Yeah, not that you guys need it..I'm sure you have everything wrapped up." said Donnie Ray.

"Hi Brenda...Good Luck Today." said Beverly.

"Hey Brenda...Good Luck." said Nelson.

"Awwww thanks guys for coming." said Brenda.

"Good Luck today Bren." said Josie.

"Yes Good Luck!" said Bresha.

It was time to enter the courtroom.....The Judge was already in the courtroom.

"Good Morning Jurors , I am Judge Julia Bruton........I usually preside cases in Bayside, but I'm on loan to Philadelphia again for this trial. Welcome to my courtroom....Due to courtroom crowding of cases , Here as in Bayside ,we are going to bypass a preliminary hearing...We know that a crime, a heinous crime has been committed so we are going to go straight to trial.. We will have Jury selection today...So Tomorrow, we will begin with trial." said Judge Bruton.. "We will start today with introductions.." she said.

She was pretty and a pleasant woman..

''Assistant District Attorney William Swift your honor." he said.

"You're a new comer...Didn't you used to be a Detective?" asked the Judge.

"Yes Mam, I did." said William Swift.

"I thought I recognized you." she said with a smile.

"Mrs Yvette Jones-Lockwood-Lead Attorney for the Defense your Honor." said Yvette.

"Keith Jones, Attorney for the defense your honor." I said.

"Mrs. Beatrice Evans-Jones, Attorney for the defense your honor." said Bee Bee.

"Mrs. Sofia Garcia-Ahmed, Attorney for the Defense your honor."said Sofia.

"Mr. Kahlil Ahmed, Attorney for the defense your honor." said Kahlil.

Jade and Brenda sat together quietly with us.

"I remember you guys from last year...about a year ago." said Judge Bruton.

Lt Tragg looked over into the visitors section he saw Olivia and her associates... "This can't be a good sign " he thought.

"Alright! With the introductions completed we'll begin with Voir Dire." said the Judge.

Voir Dire was something ADA William Swift knew about but wasn't very prepared for. He underestimated Kahlil and I immensely.. He thought ''Ohhhhh Yvette is bringing out the B team because she thinks that I am Green...Well I'll show these two."

What he didn't understand was that Yvette had trained us...We were her A-team....She had only intervened once..and that was during Judge James Wilson's tenure, when he was single handedly knee capping us..

The Fact that he saw Bee Bee and Sofia passing us notes and helping us emboldened him even more.

He really thought he was prepared for this, but he wasn't..Our questions to the jurors were laser focused and we already knew everything about all of them as well as who we wanted and we wound up getting all 12 of the jurors we wanted...including alternatives..

It wasn't until he sat down that he realized he had been snookered and that he had played right into our hands..

Brenda, very intelligent and very shrewd recognized what had just happened and she smiled and clapped her hands..

Attorney H.Stanley Stanlison, even though he didn't have a dog in this fight realized it too.

"Those kids are good..Young but good, Far more seasoned than this prosecutor....I believe they're going to eat his lunch." he said to his client, our hostile witness, Susan Hyland.

She smirked and pretended not to care.

"Okay, excellent..We have a jury....Trial will begin tomorrow at 9:00 AM , Jurors and Attorneys

let me remind you to be on time and to be ready for trial...You are dismissed." she said.

"Come on Everybody...Let's get some food and get home....Try to get some rest..."said Ms. Yvette as we

all filed out...

That night at Ms. Yvette's house..

Ms. Yvette's husband, Gary poured her a cup of tea....The Organic Orange tea she liked before bed...

"Sooo trial starts tomorrow eh?" he said.,

''Yup..We are ready...I'm just wondering what Bill Swift has in store for us."said Yvette, sipping her tea.

"You guys are the first seasoned attorneys he has faced... He has feasted off of green public defenders...Now he's facing some real attorneys..Let's see how he does." laughed Gary.

"Those are real attorneys , they're just young inexperienced and probably over worked ,bogged down with cases...My Associates are young too, but they're seasoned attorneys,more seasoned than most they're ages and they aren't bogged down with cases...Therefore they can puit their full attention on this case." said Yvette.

"Just like I'm gonna put my full attention on youuu." whispered Gary...

"Ouuuuuuuu I like that.." said Yvette..

"I like it too!" he whispered as they began kissing..

"I know you like it..Horn Dog..." she grinned...

"Ohhhhhhhhhhhhhhhhhh Vettie girrrrl!"he moaned...

"OUUUUUUUUUUUUUU SWEET HUSBAND!!!" she moaned.

Gary slowly slipped her panties down...

"I'm sorry about that...I should have made you my boyfriend then...Instead of wasting two years on those two losers I did date." said Sofia.

"Well we are married now...The way it was always supposed to be.." he said.

"Yes...." she agreed..

EIGHT TO NINE HOURS PASSED BY SEEMLESSLY...

A Nice way for all of us to begin our trial tomorrow.

ONE WEEK LATER-

ADA William Swift had put his case together well...First he showed the jurors .lurid photos of the crime scene and then he had people from the M.E.'s office as well as Police and detectives, including Lt. Tragg, who was at the scene testify.

He then talked of growing tensions between Dr. Bauer and Nurse Brenda Cherry...He even admitted to the sexual harrassment that was going on and how other women, Two Female Surgeons and a Nurse were willing to give in to the Doctor's demands..

He discussed how her complaints to Human Resources led to the Dr. being disciplined and written up and how the bad blood between the two grew.. How he requested that Brenda Cherry not be allowed on any of his surgeries...and how her performance evaluations were increasingly negative.

He was giving the jury a portrait of an angry employee who wished to get even... After the botched surgery which Dr. Bauer blamed on Brenda's unprofessionalism and "seeming lack of knowledge of surgical equipment.." he fired her! When she returned a few weeks later to clean out her desk, she found that he had thrown her personal effects in the trash...

This lead to a huge loud argument, witnesed by a lot of staff, who he brought in to testify that pushed Brenda over the deep end and lead to her killing the Doctor.

He had put his case together quite well...but not well enough.

Yvette argued that this all may have been true, but it was part of Dr. Bauer's larger plan to create a scapegoat for what he had already set in motion.

Bee Bee explained that Dr. Bauer and his patient, Susan Hyland were in cahoots and had planned the whole botched operation.

Sofia showed inquiries made by Ms. Hyland to her insurance company about how much money they'd be liable for if such a botched operation occurred...The Inquiries were made BEFORE the operation..Month's before.

ADA William Swift asked that this all be struck from the record and he asked for a mistrial....Stating that the jury had been tainted by this and that it had nothing to do with the murder or the fact that the murder weapon was found in Ms. Cherry's kitchen on the floor.

Judge Bruton said that the information was indeed pertinent and she refused to grant a mis-trial, A victory for our side.

Yvette argued about the evidence......

I argued that it was highly unlikely that Ms. Cherry would keep a blood scalpel around for a week without washing the blood off and without attempting to get rid of it..

Kahlil argued that whoever called in the anonymous tip probably put it there. He stared at Susan Hyland.

Her Attorney H.Stanley Stanlison argued vehemently that his client had nothing to do with the murder and that she and Dr. Bauer were certainly not part of any conspiracy....He argued that he planned to sue Ms. Yvette, Myself, Kahlil, Beatrice Evans and Sofia for libel and slander after this trial was over.

Susan Hyland sat with a smirk on her face....

ADA William Swift tried to divert the jury's attention from Susan Hyland..He told them to look at the evidence.. Dr. Bauer fired Brenda Cherry for whatever reason and then blackballed her..She was out of work and angry...He then tossed her personal effects in the trash...This was enough to make anyone angry and in her case , Angry enough to kill.

Ms. Yvette opened her defense by saying that Brenda Cherry not only did not kill Dr. Bauer...but that she was picked as a fall guy to cover up what Dr. Bauer and his patient had planned all along.

She then called Susan Hyland to the stand..

Susan Hyland walked confidently to the stand... She couldn't hide the contempt she felt for Ms. Yvette.

"Ms. Hyland....Did you know Dr. Bauer before your ill fated operation?" asked Ms. Yvette.

"No, I did not!" she said.

"Let me remind you, you're under oath and the penalty for perjury is pretty steep."said Sofia.

She pointed to Ms. Jade.

"We have a very good investigator...And we have here copies of a marriage license between you and Dr. Richard Bauer from Seattle, Washington where you both used to live...You two were engaged to be married..but for some reason you broke it off... So you in fact DID NOW HIM! YOU KNEW HIM WELL LONG BEFORE THIS OPERATION! " said Sofia.

"Okay, I knew him! I knew him!!" said Susan Hyland.

"According to both of your credit card records, you two dated and were seen out at several area bars and restaurants months before your operation." I said.

"In fact you specifically requested him to do your surgery..."said Kahlil.

"OBJECTION! Relevance Alright, Alright...She knew Dr. Bauer...What has this got to do with whether her client murdered the man?"argued H.Stanley Stanlison.

"Your honor, with the courts indulgence...I will prove just that." said Ms. Yvette.

"Alright, make it plain Mrs. Lockwood" said Judge Bruton.

"Ms. Hyland..You and the Doctor talked a lot on the phone...In fact he made 124 calls...124 calls to your cell phone in the days after your discharge from the hospital...up until you went to court and won your settlement.That's a lot of calls Ms. Hyland."said Ms. Yvette.

Bee Bee showed the jury a list of all of the phone calls..

"Oh he bugged me to death...Reccomending Kidney specialists who could help me learn to live with one kidney, and at one point reccomending donors for another kidney if I would like..He didn't want me to sue the hospital...A Malpractice suit is the last thing a Doctor like him, of his stature would want." said Susan Hyland...

"Yes , you told me that...."Hmmmmm well after you won the suit, He called you an additional 23 times ....and you called him 13 times , including a call made the night before he died...What more did you have to talk about?" asked Ms. Yvette."Dr. Bauer made two calls to your insurance company the day he died...He was unsucessful talking to who he wanted to talk to the first time...but the second time he was successful.. And then you got a call from the insurance company....

You know what I think Ms. Hyland?? I think you two were in this together...You two planned this whole botched operation thing to get some money from the hospital or the insurance company...It just happened that the hospital folded first.

I think you two were supposed to split the money..but you got greedy or you got mad ,finding all of those panties and bras in his apartment that didn't belong to you and after you killed him...You framed my friend, who everyone ,including you knew he'd fired and had had a loud argument with him just days before..That's what I think. It was perfect!" said Yvette.

''Where's your proof?" she asked.,snidely.

"There was several pairs of ladies panties and bras in a drawer at his house...They weren't clean...The DNA was traced to three other women, Three other women who weren't aware of each other.,They all had solid alibis. There was one pair that wasn't traced to any of them...That pair is your size and had the scent of a perfume you wear...I think they were yours...We know they were yours... The DNA from this pair of panties and from the coffee cup you drank from a few days later is a match, proving you were in his apartment shortly before he died." said Kahlil.

"Dr. Bauer made two calls to your insurance company the day he died...He was unsucessful talking to who he wanted to talk to the first time...but the second time he was successful.. And then you got a call from the insurance company....After that...you killed him!"said Bee Bee,.

''We know you killed him and we can prove it."said Yvette.

"Oh yeah how?" sneered Susan Hyland...

"How Tall are you and what is your shoe size?" I asked.

"WHAT? I'm five foot three, and why is my shoe size important?" she asked. She realized now that we knew a whole lot more than we had told her the day before.

Yvette put the murder weapon on the table...

"It still had Dr. Bauer's blood on it...but no prints...I'm guessing you used latex gloves..

"I've known Ms. Cherry since we were in second grade....She is not a stupid woman....This murder weapon still had Dr. Bauer's blood on it...It was found on the floor of her kitchen... Five days after Dr. Bauer's murder...I doubt she or anybody in here would have held on to the murder weapon that long without attempting to at least wash the blood off of it...and even then they would have discarded it..Not dropped it on the floor in their kitchen..You're five foot three..In order to place that scalpel in her kitchen, you had to stand up on something and open the window.. You stood up on this box...

that was outside her window and lifted her window up and dropped the scalpel on the floor.. Then you called Homicide from a blocked number and told them just where the murder weapon could be found."said Yvette.,

"You can't prove any of that!" she snarled...Now looking very nervous.

"Yes we can....You and I are the exact same height and the same shoe size....An imprint of your shoe is still on the box." said Sofia, showing it to the jury....and snatching one of Susan hyland's shoes off and showing the jury the match.

"HEYYYYYYYYY GIVE ME BACK MY SHOES!" Susan yelled out!

The Jury had heard and seen enough. Her Attorney H.Stanley Stanlison decided to put a halt to the proceedings, which were going down hill fast...

"As Ms. Hyland's Attorney, I don't want my client subject to anymore questions." said H.Stanley Stanlison.

"That's okay, the defense rests your honor." said Yvette.

We had succeeded in creating reasonable doubt and taking the jury's mind completely off of our client, Brenda Cherry.

90 MINUTES LATER-

The Jury was out for 90 minutes and they had come to a conclusion.. We had all been eating lunch at Sam Mothers when we got the call to come back..

"Has the jury come to a decision?" asked Judge Bruton

"We have your honor." said the Jury Foreman..

ADA William Swift looked down at the floor...he had the sinking feeling he had lost his first case...

''Artie...You shoulda checked out that Red Herring I told you about."he said.

"Face it the broad lied ......She told me the same thing she told them...but they had more evidence against her."said Lt. Tragg.,

"What does that say about you? Huh? What does that say?" said William Swift who was disgusted.

The Bailiff passed Judge Bruton the piece of paper...She read it....Then passed it to the Bailiff...

"Read it!" she said softly..

"WE REPRESENTING THE COMMONWEALTH OF PENNSYLVANIA IN THE MATTER OF COMMONWEALTH OF PENNSYLVANIA VS. BRENDA RENEE CHERRY ON THE CHARGE OF FIRST DEGREE MURDER...WE FIND THE DEFENDENT NOT GUILTY!!!" he said.

"I'd like to thank the jurors for their attention to the details of this trial...You may exit out the center doors..Your checks will be mailed to you..Everybody is dismissed." said Judge Bruton.

"WOUUUUUUUUUUUU WEEEEEEEEEEEE, THANK YOU VETTIE GIRL...I OWE YOU BIG TIME...YOU SAVED MY ASS AGAIN!" said a jubilant Brenda.

"Try to stay out of trouble okay Girlfriend?" laughed Yvette, hugging her friend..

''Wowww...all in a days work huh?" I said.

"When I saw all of the evidence we managed to pull up, I knew we were going to walk away with a victory."said Bee Bee.

"We've won cases with far less."said Sofia.

"It was all circumstantial except for the fraud, but enough to plant reasonable doubt in the jury's mind." said Kahlil.

''More than reasonable Doubt!" said Jade.

Brenda looked up and smiled.

"Olivia, Donnie Ray, Beverly,Nelson, Josie and Bree Bree....You came." she said,

"We had to come , see you get exonerated."said Olivia, hugging her latest house guest.

''We knew Vettie and company would get you off."said Donnie Ray.

"Between her crew and us..We are the best Defense lawyers in Philly!!!"laughed Beverly....

"If not the most modest."laughed Nelson...

''So glad you're free."said Josie,laughing and hugging Brenda.

"Yeah so glad you're off the hook."said Bresha.

Beverly, Josie and Bresha had gotten very close to Brenda during her stay with them..

Lee Phillips was there too...

"Congratulations Brenda... I never suspected that she was lying to me the whole time I was representing her..." she said.

Brenda hugged her... "Not your fault Baby girl...Not your fault at all..That Broad fooled a lot of people." said Brenda.

H.Stanley Stanlison walked over to Yvette.
