"I miss my baby." gushed Natalie...

"Awwwwwwwww, it has been two days." said Brooke as they both waited for my train to come in..

"This is the longest we've been away from each other since we started going together..Since we've been married." said Natalie....

I had been upstate Pennsylvania for the past two days trying to save a man on death row I believed to be innocent.  Rufus Haney...I'll talk about his case later.. I had been before four state appellate courts..

trying to save his life.....trying to get his case thrown out and a new trial ordered and had failed miserably...

I was with him at the Greene State Correctional Institution.

Just twenty minutes before he was about to be strapped to the gurney....a call from one of the Judges I spoke before stayed his execution... She didn't throw his conviction out...but she asked for a ninety day study of his case and a willingness to hear additional oral arguments from me and the prosecution in Philly..

It was a small victory, but a victory nevertheless..

My train pulled into the station....

I was sooo happy to see my two best friends.. My wife, Natalie Charles and her bestie and my bestie, Brooke Marks.

"DAVID!" said Natalie..

She rushed into my arms and kissed me passionately...

"OUUUUU YOUIR LIPS FEEL SO GOOD!" she said.

"Me and the preacher had just sat with him as he had his last meal...The guards had come to walk him to the little green room (the lethal injection room) when the phone rang and the Judge was on the line calling it off and asking for a 90 day moratorium.." I said.

"OUUUUUUUUUUUUUUUUUUUUU TALK ABOUT A LAST MINUTE SAVE!" said Natalie.

In the weeks leading up to my court appearances..

I had worked with Yvette Jones-Lockwood's team... They had told me and showed me Case files of a Capital Punishment case they had argued and lost that had gone all the way to the State Supreme Court and then to the governor.

They had lost and their client had been executed...but afterwords...The law he was executed under had been changed...

Too late for him, but maybe not someone else.

 

 

Keith Jones , who had argued the case  was still upset about losing it...but had gotten over it and had won another Capital Case.

Bee Bee, Sofia and Kahlil agreed and showed me arguments, laws, predicates and other documents related to this present case.

Jade did a little background investigating on the matter ..

And Virginia discussed with me, options I had and arguments I could present.

I used all of this knowledge I had gotten and was successful at the very last minute.

Brooke got us home...

"I suppose I'll see you guys in the morning.." she said and smiled.

"Maybe." laughed Natalie, winking....

I couldn't take my eyes off of her...She knew it and was a little self conscious.

Once Inside...

We smiled and stared at each other..

"Baby , I've missed you so much.." said Natalie..

" Great lawyering David....I wished we could have helped you. But we are working a big case ourselves." said her husband, Chip, also of the Innocence Project.

''We are all so proud of him at our office."said Karen Page, our supervisor.

"It was touch and go there for a minute kid...but you pulled through...Great Job" said Karen's Husband, B.L. ,TV Show Host, Podcaster and an Attorney himself.

Natalie sat on my lap with her arms around my neck...

"It's now 89 days....you've got more work to do and now we can help you." said Brooke.

"Tonight after work...We'll come over and look at some things ." said her husband, Sean, a Federal Public Defender.

Zoey sat with her head nestled up under her husband, Lem's broad shoulders..

It was the same for Renee, She was on her husband, Tyrell's lap...

andTyrell was holding her gently as the train rocked from side to side.

Tony was looking out the window at the train tracks...

So was Paris..

 ''Well guys we just wrapped up a big case, Let's see how many days of rest we get before we are on another one." said Ms. Yvette.

"I could use two or three."said Keith Jones.

"Yeah, me as well." said his wife, Bee Bee.

Sofia was sitting on her husband Kahlil's lap...enjoying the ride to work...

Kahlil was dozing in and out of sleep. 

Jade was just quietly enjoying the ride..

As was Virginia, restimng on her husband, Jetty's shoulders...

Jetty was dead to the world...knocked out..

As our train headed to work.

We sat in Karen's office and I talked about my present case..

Karen, Brooke and Natalie all sat around with coffees

"As you know ,I was approached by an Attorney still with the Public Defender's Office-

and a former colleague of ours named Adam Clarke about the case of Rufus Haney, who had been on death row since 2019 and was facing execution... It was one of many cases he had worked on and he was saying it was right "up my alley"..."You like lost causes, you should look into it." he said... "By the way, nice office and congratulations on snagging Natalie...I never woulda put the two of you together." he said.

Rufus Haney is a Philadelphia man convicted and on death row for the murder of his two-year-old daughter in 2018. Rufus Haney was accused of severely assaulting his daughter and causing her death, and was tried and convicted of capital murder and sentenced to death in 2019. He had lost his appeals since. 

Rufus Haney conviction was based on blunt force trauma; however, shaken baby syndrome was also invoked, which has been argued by some to be "junk science", leading to controversy over the conviction. In addition, Rufus Haney's lawyers Adam Clark and Linda Slade , Philadelphia Public defenders argued that his daughter had suffered from pneumonia which had progressed into sepsis by the time of her death.

However, the use of the 2013 "junk science law" as a defense was not successful. Rufus Haney maintained his innocence throughout the appeal process. Rufus Haney was scheduled to be executed on Just a few day ago, but the Pennsylvania Supreme Court granted a stay of execution to allow his testimony before the Pennsylvania House Committee on Criminal Jurisprudence. We have 90 days, well 89 days now to present new oral arguments." I said.

"And you did a masterful job David..Boss man ,Gil Garcetti who rarely if ever heaps praises on this office called yesterday to talk to you...to congratulate you, but I told him you weren't back yet from upstate." said Karen.

"That's my baby!" said Natalie proudly...

"How can I tell you no? Next to Yvette, You're my closest Friend." said Karen...hugging her good friend.

"Awww thank you It's very rare that we get overwhelmed with cases....but this is a particularly busy season for us.. as you know me and my entire staff have been in this building all week..

Nelson is working a case with Jessica and Chip for the Innocence Project-

and another case with Dabnis, Ray,Tony,  Paris and Tyrell....So he's tied up..

And my girls, Beverly and Josie ,my other right hands....

are working a case with Jazzy, Kayla, Zoey and Lem....

and Bresha and I are working on a case with Renee....

So I come to you with another Wrongfully Convicted case...... Mark Williams... He's on Death Row at Greene Correctional Center....I know David is working a case there now...If you could look into this for me...I'd be so grateful...." said Olivia , who put the case file on Karen's desk.

"Sure Liv, I'd love to...after all this is up our alley, Wrongfully Convicted cases... You usually get em before they are convicted." she laughed.

"Yeah, I know right?" laughed Olivia.

Karen called Natalie and Brooke into the office-

"Hi Olivia." said Natalie..

"Hi Olivia.....I saw Beverly and Josie in the hallway." said Brooke.

"Hey ladies...Yes..We are all here today in some sort of  way....Beverly and Josie are working down the hall...So is Bresha... and Nelson is both down the hall and downstairs.We are overwhelmed for the moment...Which is why I brought this case to you guys... I just can't take on another case at this time.."said Olivia.

"Say no more...As much as you've helped all of us in the past, how could we say no to you?" said Natalie.

"That's what I was telling her..." said Karen...

"Let's look at the case file." said Brooke.

MARK WILLIAMS-

Mr. Williams was sentenced to death for a crime he did not commit. In 2020, he was convicted of first-degree murder, robbery, and burglary in the 2019  killing of Felicia Hershey, a former Philadelphia Daily News reporter. 

His conviction primarily relied upon the inconsistent testimonies of two incentivized witnesses, with no physical evidence linking him to the crime scene. 

While DNA evidence not available at the time of Mr. Williams’ trial proves his innocence, it has not been considered in court.

"We'll need a couple of days to look at trial transcripts, Go over witness statements and get an investigator,,,Then we can head up to Greene...." said Natalie..

"That'll be the same time that your hubby will be going back there for a visit with his client and to make oral arguments... I'm going to talk to my hubby and get him to go with us...It'll be kinda nice I suppose."said Brooke.

"Thank you ladies so much...We are completely covered now..."said Olivia.

"Oh Olivia , you know you're always welcome." said Karen..

I walked into the office just then...

"Hi Olivia." I said.
