VENTURES: Foslow's Folley

EARLY MORNING-TWO DAYS LATER!

We were having breakfast at the restaurant attached to the Condo where our clients, The Colgates lived..

Hot Coffee was brewing...

Eggs were being put on plates,,,

Pancakes

Bacon

Sausage

and Hash Browns were displayed...

''One thing I will say...This restaurant is nice.. The food is delish." said Bee Bee.

''Maybe we'll bring all of the gang here one Saturday." I said.

"That would be a good idea." said Sofia.

"Heads up..Here's our guy!" said Kahlil..

Fred Foslow walked in...The first thing he noticed was us!!! We were the only people of color in the entire restaurant..

Me and Bee Bee , a Black Couple.

Sofia ,obviously a Latina female and Kahlil, A man of middle eastern or Arabic descent..

He stared at us...but didn't make any more of it.. It's a free country after all and we weren't causing any trouble.. We were well dressed and eating and talking quietly...

He ordered his breakfast..

an everything omelette

and hot coffee..

He sat two tables over from us.. We didn't intend to let him leave here without dropping the subpoena on him.

He was going to make it easier for us than we thought. His racism and curiosity combined was going to do that...

As it turned out...All us finished eating our meals around the same time.. He got up and walked over to our table..

"Hello.. I uh couldn't help but notice you guys...uh...I see you're all married." he said.

"I'm Keith Jones...I'm an attorney and this is my wife, Beatrice Evans-Jones." I said.

"I'm also an attorney...We both work at McCluskey/Cozen/Connor & Pratt" she said. We showed him our work I.D.'s.

"I'm Kahlil Ahmed, I'm also an Attorney... and this is my wife, Sofia Garcia-Ahmed." he said.

"I'm also an Attorney." said Sofia Ahmed, showing him her and Kahlil's work ID's... "We all work at McCluskey/Cozen/Connor & Pratt." she said.

"Lawyers huh? You guys uh newlyweds? Looking to move into this Condo complex?" he asked.

"Excuse me...I'm going up to pay the bill." said Bee Bee, who had the company credit card.

''Nah...We've been married about two years and we just bought homes." said Kahlil, answering his question.

''Well what brings you guys here?" he asked.

"YOU!" I said.

"Me? Do I know you guys?" asked Fred Foslow.

"No, but you will...We'll see you in court." said Sofia, who slapped the subpoena in his hands...

"Bye now...We can go.." said Bee Bee.

"See you in court Mr. Foslow..It was nice talkin to you." I said.

"Byeeeee" said Sofia.

"I got a question for you....If we were White, would you have been that interested in our occupations and whether we intended to move into your condo?" asked Kahlil.

He stood there looking confused..

"They're Colgate's attorneys...They've subpoenaed me as a "Hostile Defense Witness" How did they get my name?? How did they even know I existed?" he exclaimed.

"That was Bee Bee on the phone.. Mr. Foslow has been served." said Yvette.

"Yayyyyyyyy!" said Virginia.

"Game, Set, Match! " said Jade.

THE OFFICE OF DEPUTY DISTRICT ATTORNEY LESTER BURKE-

Lester Burke sat in his office with ADA Michelle Battles...

"This case is a nightmare...First of all the victim was a floater...Body found in water...No prints, No DNA...Not one eyewitness or witness of any kind...No tracing of the man's last hours...and the only motive supplied is one of hearsay...a motive supplied to Lieutenant Tragg by an anonymous tipster...

We have a murder weapon..a gun, also supplied by this same anonymous tipster..A gun the cops missed the week before, but miraculously showed up this week... Serial number scraped off... If I go into court with this case as it is next week... I'll look like a fool." said Michelle Battles..

Deputy Burke looked at the dossiers on us , the defense team..

"Ouuu Colgate hired some Killers... I don't know them personally...but I've seen them in action...They're good.." said Lester Burke.

"I know and I know them personally...I went to high school with three of them...They were much younger than me and a fourth one was in college with me...Howard University...He's your Frat brother in fact....and their Boss Lady, who I don't know is my soror." said Michelle..

"That won't stop you from doing your job will it?" he asked.

''No..Of course not..but with what I've got...I'll go into court and look like a fool." said Michelle.

''Do you think he did it?" asked ADA Burke.

"Going by this weak crap...No!" said Michelle Battles.

"Then drop the damn charges... I had a case brought in by Lt. Tragg...It wasn't as weak as your case...but pretty bad... So Bad, I went over his head.. I had an investigator from the D.A.'s office and some detectives from the Criminal Investigation Division look into it...After I got their report, it was quite obvious that the man he arrested was innocent...and to make it worse...The Defense team's investigator actually solved the crime, identified the real killer.. I tossed that case out and had the defense attorneys explain it to him...He was furious and stormed out of the office.. Here is a photo of me and the attorneys involved.. It was no hard Feelings.." he said.

He showed her a glossy photo of Olivia Bennett-Alexander, her niece, Beverly West, Olivia's husband and investigator, Donnie Ray Alexander, himself, Josie Boyd ,Bresha Billips and Beverly's husband, Nelson East taken in this very office.

The man standing next to me is Olivia's husband, Donnie Ray Alexander, a former Homicide detective, who actually solved the case." he said proudly.

"You've done a lot in this office ,huh?" laughed Michelle..

"I have indeed " he said, locking the door and pulling the shades down, laughing raffishly...

"Can I have a kiss?" he asked her..

"Sureeee." she said.

She kissed him passionately...He unloosened his belt and dropped his trousers...His boxers were standing out like a circus tent..

The whole gang was here tonight.. The couples, Jazzy and Dabnis, Kayla and Ray and Jessica and Chip were sitting at seperate tables on the other side of us..

''Well it's nice to have a reason for us all to leave the neighborhood every now and then." said Olivia, who had loaded us all up in her buses...Everyone except, Jetty and Virginia, who came in his car.

"Hopefully we'll have a nice night..a nice enjoyable night."said Donnie Ray.

" If Columbo is still locked up we will." said Alfreda.

"He's not.. he was released this morning..I saw him.."said Rockland..

"Oh Well.." said Virginia..

''Oh well hell.. He comes in here startin something , I'll kick his ass and have him locked up again." said Jetty..

''Cool your jets....Here comes our food." said Virginia.

The Special tonight for couples was Filet Mignon steaks and Baltimore Crab Cakes..

And plenty of beer to wash it down...

The arrival of our food made us forget all about the possibility of Lt. Tragg crashing our party.

We were 26 strong tonight!

ADA Michelle Battles came in, she saw all of us sitting together...

"HEYYYYY ADA BATTLES....COME ON OVER!" said Bee Bee.

"Pull up a table.. Join us.." said Kahlil..

"There's room." I said..

"These are our neighbors and colleagues..." said Sofia..

"I'm the only one here that's not part of a couple.." said ADA Battles shyly as she pulled up a table and sat with us...

"Hey! I hate to talk shop at this moment...but that gun... My husband is a cop, Lt. Danny Ho- Robbery -Homicide.. He took it to the ATF and they IDed the owner...A Fred Foslow.... I tracked all of Lt. Tragg's calls on and around the murder and I ran the numbers by the FBI...and guess what? His anonymous caller was Fred Foslow.. He lives next door to the Colgates, so he sees all of the comings and goings ,knows all of the scuttlebutt...and he called Lt. Tragg and he placed his gun in that dumpster ,which cleared ballistics and is the murder weapon... We've subpoened him as a hostile defense witness..He knows a lot more than he's telling." said Jade.

"That was good work...You're worth your weight in gold.." said ADA Michelle Battles.. "Yvette!! Soror!" she said.

"Heyy Soror..Skeeeee Weeet!" said Yvette.

''Skee weet!" said Olivia, smiling..

"Oh wowww, another one.. Yvette, how bout you and your guys meet me in Deputy Lester Burke's office tomorrow and we talk about dropping these charges formally... I'll bring Judge Cummings."laughed Michelle.

"I think that would be great.."said Yvette.

"Oh Look at this... Ouu it looks delish." she said..

As her Filet Mignon and Crab Cakes arrived on a platter..

Freshly freed Lt. Tragg walked into the bar just as we all began to chow down.... He was astounded seeing ADA Battles sitting with all of us, eating,laughing, drinking enjoying herself.

He pointed at her and motioned for her to come to where he was..

"Ignore him, finish your food..Who does he think he is?" asked a very annoyed Yvette.

"No...I've got something to tell him...I'll handle him." said ADA Battles as she got up and headed towards him..

"YOU! You have no business in here fraternizing with the attorneys you are going to be trying this case against...Now I've told you this before...Tomorrow I'm going to have a long talk with D.A. Garcetti." said Lt. Tragg.

"No You are not!!!While you were in jail..The investigator for the defense, Jade Lee did the job YOU should have been doing.. She identified your anonymous tipster...Fred Foslow....The next door neighbor of the Colgates... Oh and she took the murder weapon over to ATF...The IDed it's owner...also Fred Foslow..They subpoened him as a "Hostile Defense Witness" but I'm going to go a step farther.. I'm going to arrest him as a Material Witness in this case. You don't like to use other channels, that's obvious.. She used the FBI, The ATF and Robbery-Homicide detectives and she cracked what now should have been an easy case... Had you have had a little imagination and initiative...Things that make a good detective." said ADA Battles.

"AND WHAT WOULD YOU KNOW ABOUT BEING A GOOD DETECTIVE?" he snarled.

"Plenty! This aint my first rodeo Lieutenant.. I was a Public Defender and an Assistant District Attorney for Years in Washington D.C. before I came here."said Michelle Battles.

"Well Lahhh Deeee Dahhh ! I'll pick him up." said Lt. Tragg..

''No you won't...As of this minute, you are off this case...You are not to arrest anyone or go anywhere near the crime scene.. You can be present tomorrow morning at 10:00 AM in Deputy District Attorney Lester Burke's Office. That's what you can do...Now Good Evening Lieutenant!" she said sharply and returned to her seat.

Lt. Tragg stood there staring balefully at nothing in particular..

IV-

THE NEXT MORNING - 5: 45 AM

Naturally Lt. Tragg didn't listen to ADA Michelle Battles.. He was determined to make the "collar" and to put this case to rest.... He called the Tactical Squad and prepared for a pre-dawn strike...He appeared in front of the Condo that The Colgates lived in with a Tactical Unit and the Press, who were mysteriously called about the inpending bust.

"WHEN I GIVE THE WORD... YOU GUYS MOVE....IT'LL BE AN ATTACK OF SHOCK AND AWE!" he said in dramatic fashion.

Many of these men were angry at being called this early.. They were Hungry and didn't see the need for them to be there to take down one man... But Lt. Tragg loved to do things with a dramatc flair.

The Press were there snapping photos.... This was called breaking news.

So you can imagine his surprise...You can imagine everyone's surprise when they saw Detectives Reed and Malloy coming out of the building with Fred Foslow in handcuffs..They had three uniformed officers with them.. He was being held as a "Material Witness " in the Spann Murder..

Fred Foslow was confused... He was subpoened by us the day before and now arrested by Homicide Detectives he didn't even know.. How did they discover him? he wondered.

The press shifted from Lt. Tragg and shifted to Detectives Reed and Malloy...They gave a short statement and took Foslow to Central Booking.

This infuriated Lt. Tragg. The Press and the Tactical Squad all left and he was once again with Egg on His Face...

THE OFFICE OF DEPUTY DISTRICT ATTORNEY LESTER BURKE-

Lt. Tragg entered the office and saw Ms. Yvette, Myself, Bee Bee, Sofia ,Kahlil and Ms. Jade all sitting in a semi circle...

and drinking cups of coffee...

He also so the Colgates.

Joseph and his wife, Olivia who greeted him with Icy Stares.

Also there was ADA Michelle Battles and Judge Elise Clemmons.

Deputy District Attorney Lester Burke broke the ice..

''You're late today Lieutenant ...Out fighting crime?' he asked.

The entire room exploded into loud guffaws of laughter.

We had all seen the Early Morning News Broadcast in which according to the Press, "He Had gotten his signals mixed up." The whole City had seen it and once again, he was the laughing stock of the entire Philadelphia Police Department.

He was furious at being made the butt of the joke and even more angrier at ADA Battles for having two of his detectives make the collar of Foslow. She had made him look like a fool.. He hated smart alec Deputy DA Barnes as well...

"The People are dropping all charges against the Colgates Lieutenant!

Mr. Foslow confessed to killing Tony Spann an hour ago...He said he did it and framed Dr. Colgate, hoping to have Mrs. Colgate all to himself.. You can thank Jade Lee...

Her investigative work cracked the case...Which is more than yours did...Hopefully I'll never work another case with you ever...You are the worst detective on the force...bar none." said ADA Battles.

He snarled at Jade Lee..

"One of these days... I'm going to have the pleasure of snatching your damn license..." he said and turned and stormed out of the office..

''Well don't go away Mad... Just go the hell away." said Deputy District Attorney Lester Burke..

ADA Battles, Ms. Yvette, Ms. Jade, Me, Bee Bee, Kahlil , Sofia and Judge Cummings all burst into loud guffaws.

"What an idiot.."scoffed Joseph Colgate.

"I'm just glad this is all over." said Olivia.

I put my arms around Ms. Yvette..

"See? We didn't have to go to court..." I said,.

"We got lucky....Don't count on it all the time." she said.

"If we had of.. We would have won this one." said Bee Bee, hugging Ms. Yvette.

"Oh Most definitely..." said Ms. Yvette..

as we all piled out...

With everyone gone....ADA Battles faced Deputy DA Burke..

"Thank You....Thank you for saving me from what could have been an embarrassing defeat in court.. I haven't lost yet and I'd hate to lose a case like that.." she said.

"You really should thank the defense.. They did such a sterling job that you really had no choice but to proffer a deal or drop the charges.. I just merely guided you in the right direction.." he said..

"Mmmmmmmmmmm you're so modest." she whispered as she kissed him passionately...

EPILOUGE-

Fred Foslow was convicted of First Degree Murder and sentenced to 25 years to Life...

A FEW DAYS LATER-

"Hey Guys...Look who's here and look at what she's got." said Ms. Virginia.

It was Olivia Colgate,. She had a super deli tray with an assortment of meats and cheeses, mayo and mustard and hard rolls for sandwiches...

"Ohhhhh Myyy" said Ms. Yvette.

"OUUUU LOOK AT THAT!" said Bee Bee.

"For Us?" asked Sofia.
