TRIAL DAY- The Courthouse waiting area.

"Coffees everyone!" said Beverly

She and Nelson had gone to fetch coffees for all of us today...

Nelson had lipstick smudges from Beverly all over his face and his lapel...

"This is getting to be a thing with you two isn't it?" joked Olivia, taking out disinfectant wipes and cleaning Nelson's face and lapel..

Beverly took out a small mirror from her purse and reapplied her lipstick.

"Thanks for the coffee Bev, Nelson." said Josie..

"Thank you Beverly, Nelson, for the coffee." said Kyra , who was kind of somber this morning.

"Thanks for the coffee...I must say Donnie Ray, it was nice running into you at Barkley's..You and your people should come out again." said our client, Attorney Harvey Bailey.

"After we get you off...perhaps we'll celebrate there.." I said.

ADA William Swift walked in...Like me , he was an ex cop...An ex-Homicide Detective who went to law school at night and took the bar five times before finally passing it.. He had been a rather successful Assistant District Attorney...He wasn't a bad guy...I was actually happy for him.

Lt. Tragg walked in with him... Once Lt. Tragg had been his superior...Now William Swift, ADA William Swift was calling the shots...How different that must feel.

He looked over at us..Most of us drinking coffee, laughing and talking...Olivia wiping lipstick off of Nelson's face, Beverly applying lipstick and Kyra and Harvey sitting with us without a care in the world.

The Press had been barred from these proceedings..

"I wonder who the Judge is in this case..Must be a real Hard ass." smirked Lt. Tragg.

To his surprise...It was Kelly Anne, His Kelly Anne!!! He couldn't believe she had barred the press from these proceedings.. Her reasoning..She wanted a fair trial and clear headed attorneys...No show boating and no surprises...We couldn't have agreed more..

Although I could see why this would've bothered Lt. Tragg..

COURTROOM E-

"ALL RISE FOR THE HONORABLE JUDGE KELLY ANNE MERCER!" said the bailiff.

"Be seated, Be seated...Good Morning Attorneys and Jurors....I am Judge Kelly Anne Mercer as a lot of you know...I would like introductions of Attorneys first..." she said.

"Representing the Commonwealth, Assistant District Attorney William Swift your honor.." said Bill Swift.

"Olivia Bennett-Alexander-Lead Attorney for the Defense your honor." said Olivia.

Our client, Attorney Harvey Bailey stood next to her...

"Co-Lead Attorney for the Defense, Beverly West-East your honor." said Beverly....

"Attorney for the Defense, Nelson East your honor." said Nelson.

"Attorney for the Defense, Josephine Boyd your honor." said Josie.

"Attorney for the Defense, Bresha Billips your honor." said Bresha.

I stood quietly by them...

"I believe you all have tried cases in my courtroom before...Even the defendent!" said Kelly Anne with a smile...

This brought the courtroom to laughter...She was a real sweetheart.

''We'll have juror selection now." she said.

ADA William Swift really thought he was prepared for Nelson, but he wasn't..

The Fact that he saw Josie and Bresha with their laptops , passing Nelson notes and helping him, emboldened him even more.

Nelson's questions to the jurors were laser focused and he already knew everything about all of them as well as who he wanted and who he didn't, and he wound up getting all 12 of the jurors we wanted...including alternatives..

It wasn't until he sat down that ADA Swift realized he had been snookered and that he had played right into our hands..

"He's really good." said Harvey Bailey with a smile..

"Okay, excellent..We have a jury....Trial will begin tomorrow at 9:00 AM , Jurors and Attorneys

let me remind you to be on time and to be ready for trial...You are dismissed." said Judge Kelly Anne.

Trial Began the next day..

ADA William Swift began his arguments with shock treatment...Showing the Jury 75 inch still photos of the crime scene..The lurid photos of the two people, Attorney Peter Marcus and Felicia Nelson -Bailey, the estranged wife of his partner, Harvey Bailey.the defendent....

He argued that tensions grew between the partners in the law firm, Harvey Bailey and Peter Marcus and that walking in on Mr. Marcus and his wife in bed together was the straw the broke the camel's back.

He had witness statements of two people who claim they saw Mr. Bailey leaving the building, running.

Josie got one witness to admit that she was far sighted and had problems seeing people from a distance.

Bresha read the one witnesses testimony that she saw a man about 5 foor eight in a green jacket exiting the building... Harvey Bailey is six foot ,three, The same height as me and does not own a green jacket..He was wearing a brown jacket that night.

William Swift showed camera footage of Harvey Bailey exiting the building....

Nelson argued the difference in height and the Brown jacket versus the green jacketed man who exited first, before Mr. Bailey arrived.

ADA Swift returned to his theory of tensions in the marriage and catching the law partner in bed with his estranged wife driving Harvey Bailey into a murderous rage... It was his trump card.

Olivia and Beverly argued that Mr. and Mrs. Bailey had been seperated for close to two years...and that Mr. Bailey no longer lived with her and both people were seeing other people.

They even brought in some of the people that both of them had been dating.

William Swift continued his arguments based on jealousy and closed his case in two days....

We were going to begin our defense, the next day.

That night though, at home was a different story...

Nelson hammered home that no attention had been paid to the man in a green jacket who was seen exiting the building just before Harvey Bailey arrived...Nelson showed the jury copies of Harvey Bailey's phone records which show him receiving a call from his partner Peter Marcus concerning some legal papers regarding another client he was representing...

Josie showed the Jury a recording of the actual 911 call made by Harvey to the police, minutes after
he witnessed the double homicide.. He was just two blocks away...

Bresha pulled the hat trick... Nelson and I had found the second man leaving the building that night...on the Street Cam and the ATM cam from across the street...She showed it to the jury...

I had identified and found the man and slapped him with a subpoena.

Daniel Baum, the son of Judge Carter Baum....

"With Drugs... You've had two arrests for possession of Heroin and Fentynol...both arrests were wiped off of your record and no jail time was served... You were in Rehab twice..What was your business with Mr. Peter Marcus that afternoon? And don't say you didn't have any business....We have photos of you entering the building where he lived and we have copies of your phone logs... You called him at his office seven times that day."asked Olivia.

"I spoke to him about a job....I needed a job!! I needed money." he said, still twitching.

"You needed a fix! "said Beverly... You put in an application, but Mr. Marcus rejected it.. He told you to clean yourself up and then he'd hire you....You came in and asked him if you could borrow money...He told you no....and to get out... I have three administrative assistants and a Para-legal who will testify that they heard this conversation." said Beverly..

"You went to his apartment...because he wouldn't take your calls....didn't you? What did you do once you got there?" asked Olivia.

"I-I-I can't answer that....I-I need legal counsel." he said.

"That's a good idea....The defense rests your honor." said Olivia.

Like William Swift....We had rested our case in two days...It was Wednesday...

"Alright, we'll have deliberation...If you can't come to a decision today..We'll meet in here tomorrow morning at 9:00 am sharp...Court is dismissed...

William Swift was livid...He had asked Lt. Tragg to go back over this case with a fine tooth comb...He hadn't..Had he...this guy, This Man in the Green Jacket wouldn't have come up...Obviously, Donnie Ray had gone over it with a fine tooth comb, he thought...He stomped his foot hard and banged his fist on the table.

Lt. Tragg wasn't thinking about the case at this moment..He and Judge Kelly Anne were in the locked Judges Chambers

He passed it to the Bailiff, who passed it to Judge Kelly Anne.

She read it and smiled....She passed it back to the bailiff.

"Will the Defendant and his attorneys please rise." she said.

Harvey Bailey stood up... He was certain he was going to be acquitted.. He looked very confident...He was quite pleased with our defense.

Olivia held my hand...She shook a little.

I softly squeezed her hand...

Beverly removed Nelson's hand from her butt... She looked at him and smiled...

Nelson smiled sheepishly... They weren't worried about the verdict.

Josie was always worried, Never really sure we had won...

Bresha had mixed emotions..She looked like she went either way.

Kyra was here today, for the verdict.

She looked hopeful.

Manslaughter...We find the defendant, Harvey Bailey, NOT GUILTY!

On Count two Second Degree Murder, we find the defendant Harvey Bailey, NOT GUILTY!!

and on Count one, the most serious charge, Murder in the First Degree, We find the defendant,

NOT GUILTY!

The Judge had the jury polled and each one said the same thing-NOT GUILTY!

"YEAHHH!" said Harvey Bailey pumping his fists... "GREAT JOB OLIVIA!! GREAT JOB GUYS!"said Harvey....

Olivia and Beverly leaped in the air and high fived each other, shouting "WHOOOOOOOOWEEEEEEEEE!" as they usually did..

"I hate when they do that." scoffed Lt. Tragg.

"Maybe if you'd gone over this case with a fine tooth comb like I asked you, we wouldn't have been surprised and maybe they wouldn't be jumping up and high fiving each other."scoffed William Swift, angrilly storming out of the court room..

Olivia and I stood in a corner kissing passionately....

As did Beverly and Nelson

"They keep kissing like that, they're going to have each others clothes off in this courtroom..."laughed Josie.

As of this date, Daniel Baum has not been charged with the murders of Peter Marcus and Felicia Nelson. No Murder Weapon has been found and his prints were not on the premises...

He is however in a new rehab center and program.

Harvey Bailey elevated Kyra to Partner at the Law Firm and changed the name to Bailey and Hilton Attorneys at Law!

"A nice way to celebrate getting an acquittal of a major client." said Jetty.

"You think Judge Carter Baum's son will go down for this?" asked Jazzy.

"They are certainly looking hard at him...but with his father's pull, he won't get the book thrown at him."said Dabnis as he munched on a sandwich and quaffed a beer.

"He's already been put in a rehab program.." said Kayla.

"It's a facility that is 25 miles northwest of the city.......Rich and connected peoples problems eh?" said Ray.

"They haven't found the murder weapon yet..."said Jessica.

"His mind wasn't so addled by drugs that he didn't forget to get rid of the murder weapon."said Chip.

"No prints were found at the murder scene...It's going to be hard to get a conviction....but I think they'll get one..He might even confess for a lighter sentence..."said Karen.

"Like 10-15 years....20 at the most..."said B.L.
