"It always smells so good in here...I could stand in here for hours." gushed Brooke...

"I know...I love the smell of this place." said Natalie.

where they ordered Bagels with Cream Cheese and Jelly...

Pastries

and Doughnuts fresh out of the oven...

and Two Thermos's of hot coffee....and paper cups.

We took Natalie's Blue Nissan Versa...with Natalie driving.

She looked at me ,sleeping comfortably in the back seat and turned to Brooke.

As the Three of us drove towards the prison.

We walked down that creepy hallway to the visiting room....This time we didn't hear any yelling or screaming from Former Judge James Smith.

The Death Row visiting room we were in was a little nicer...

Eugene Grimes looked around the room...

"Your Husband is missing Mrs. Marks and the other lady..." he said.

"Her Husband, Sean Marks and our boss lady, who you haven't met yet are arguing for your clemency as I speak in a State Appellate Court... The Other lady, The Assistant District Attorney is with them." I said.

"You haven't been abandoned...It's a team effort." said Brooke.

"Now come on...We brought you Breakfast..."said Natalie, smiling.

"Bagels and Cream Cheese....I haven't had these since I got arrested...Three years ago." he said.

He eyed the pastries..

The Doughnuts

and the hot coffee...

"We are going to need fresh DNA from you today....To match the DNA found in the semen of the dead girl...You'll get a more thorough DNA test this time....The kind your former attorney should have ordered."I said.

"In all fairness...He did ask for it...but that jackleg Judge, James Smith denied it...He said Two was good enough ,even though both were inconclusive." said Eugene Grimes.

I don't believe in luck...I believe you make your own luck... But I have no definition for what happened today..

We got Judge Delores Sykes...

"I don't believe it!! We meet again Sean." she said with a big smile on her face...

"Yes....isn't that something?" said Sean smiling broadly and trying not to smile too broadly....

The last time we were in her courtroom, Karen and I were arguing for the freedom of Debra Brown...Not a Death Row case, far from it...And we easily got it tossed out...

Today we were arguing for clemency for a condemned man, a man facing the needle within two weeks..

We were in a desperate situation, very desperate...

Karen gave an impassioned argument first......She spoke about how a condemned man told them that our client, a man convicted and condemned to die confessed near the end that our client,.,his co-defendent was actually innocent , that he had nothing to do with the rape/murder they were both convicted and sentenced to death for and how he left directions to the actual second man's remains for us and confessed to murdering him as he was about to be executed. She argued passionately for his life to be spared.

Then Sean began to talk about the Prosecutorial Misconduct, The Witness Statements that were suspect,

Inconclusive DNA and the fact that we were gathering new DNA as he spoke...He argued passionately for Eugene Grimes life to be spared to be spared.

Delores Sykes was paying rapt attention to Sean when he spoke....He was wearing a nice tailored suit that fit him in all the right places...and he had on a brilliant fragrance.. Her mind was going back to years ago when they shared a bed together..

Sean was blushing something crazy.....He hadn't heard Monique and Karen's conversation, but he knew that they knew what had just happened...Brooke had been right..Judge Sykes was in another world, daydreaming about the night they had spent together years ago...

Brooke smiled knowingly....A knowledge she kept to herself.

We all met back at our building's Cafeteria...We were just in time for dinner...

I was in a daze after that kiss from Natalie.

"We've got work to do...We've got to prepare for Night Court." said Brooke.

"Right , we've got to work on getting him out period...He's been locked up for three years." said Sean.

"That'll be great news for him." said Zoey...

"Yeah and imagine walking the streets as a free man after three years." said Renee.

"That will have to be a good feeling."said Tyrell.

"He was just a week away from getting a needle...and now he'll be walking the streets again." said Lee.

"He's in a cell next to the man who sent him there...James Smith....I imagine he's really going to feel so bad seeing this man walk free, while he's awaiting his own execution." said Matthew Ake.

" I'm happy for you Karen, Natalie, David, Sean, Brooke and Monique." said Nina.

"We are a pretty formidable team aren't we?" Joked Karen...

"Yes We are!"laughed Natalie..

I hugged her and smiled...

Sean hugged Brooke...

"My guys deserve some rest...We've had one case after another...7 straight cases and 7 straight wins.

I'm giving you all the next few days Off." said Olivia.

"Those five with me were draining enough and then you guys would up repping me....and now this case...Yeah Olivia, you all deserve a break." said Monique.

" Good ,I could use some extra sleep and some time to compose some music." said Donnie Ray.

"You and I can get away, do a little shopping, a little hanging out." said Beverly.

"Yeah I could really get behind that." said Nelson..

Josie was glad to be with her husband again...Sitting on his lap and kissing him like kissing was going out of style.

"Shame this is a Wednesday, we could all go out drinking." said Virginia.

COURTROOM E- TUESDAY SIX DAYS LATER-

NIGHT COURT- TUESDAY NIGHT , 8:00 pm

In Philadelphia, Night Court only operates two nights a week....Tuesday and Thursday, Tonight was Tuesday...and fortunately...We got an arraignment date of 8:00 pm. We had been working furiously fast.

The Judge in this case would not be the Judge in the actual case....

Neither Lt. Tragg ,nor the arresting detective in this case was there... Night court was too low profile for him...No witnesses...No media..and a bunch of Judges and ADA's who were mostly older Judges and ADA's about to retire...It was lightweight. It was in session from 7:00 pm- 10:00 pm Tuesdays and Thursdays...We were quite fortunate to get a date.

We had gotten Eugene Grimes conviction tossed out just six days before and he had been removed from death row and transferred to the City Jail. He was no longer locked down 22 hours a day...He was allowed to be in General Population now...

The ADA that did show up was not going to be the ADA that tried the case...He had only the basic out line of the case at hand... He basically wanted to go home...So he didn't really put up much of a fight.

Eugene finally met our boss lady ,Karen Page Benz, who was with us tonight.

Karen came with the Bail Bondsman that Olivia and Yvette always used...

Me, Natalie, Brooke , Eugene Grimes and Sean all sat together...

"It's not crowded tonight." I said.

"I know they're happy ..They can get out of here early tonight." said Natalie.

"We've been pretty fortunate so far in this case...Let's hope our luck doesn't run out." said Brooke.

"I'm with you Brooke,." said Karen.

''Where is Ms. Monique tonight?" Eugene asked.

He liked all of the female attorneys representing him...They were pretty and all smelled so good..

It had been three years since he'd been near a woman... Sean and I understood.

"She's Home tonight...You'll see her when your trial comes up." said Sean.

Eugene was not the easiest man to defend...He had a juvenile record, he had recently been freed from Death Row....

Surprisingly though we found seven charactor witnesses , Including a Priest from his former parrish.

And to our surprise...The Judge released him on his own recognizance but with one condition..

He had to wear an Ankle Bracelet .....With restrictions... He had to be in the house by 11;00 pm on Weeknights and Midnight on Weekends...

"I can't believe it....I can't believe I'm a free man, Semi -free anyway....but anything is better than being locked up!" he said.

"You were one week from getting a needle my man." I said.

"Yeah this was a close one." he said.

We made arrangements for him to stay at a halfway house...We told him we'd check in on him....He thanked us all profusely as we drove away....

Miles away.... Monique was in her new apartment with her girlfriends... The women who lived in her apartment...She wasn't out tonight...She was enjoying quiet time with her apartment mates..

"This is our little wine down...Drink up." said Serendipity, passing Monique a beer..

"Shame we don't have any joint...That would go nice with this." said Monique.
